I was off my job this month on the 11th and my car was in the shop. I use my car as a pizza delivery driver at Domino s Pizza. I need to collect my benefits in order to go back to work and get my car out of the shop.

I had applied for unemployment benefits November of 2012. It was approved by adjudicator 1240. However, I did not continue because I had an upcoming surgery, and would not have been able to properly look for employment as required. I have since had the surgery on 1/9/2013 and I am now looking for work. I also retired and receive $1200/month. Can I still receive my benefits?

Severance Pay can reduce Ohio Unemployment Compensation Benefits

Severance pay in Ohio can reduce or eliminate an employee’s unemployment compensation benefits for the weeks that the severance pay is received. If an employer pays severance pay in a lump sum, the Ohio Department of Jobs and Family Services (ODJFS) can allocate the lump sum severance payment to the period of unemployment that it covers and reduce unemployment compensation benefits for those weeks.

Unemployment Compensation Eligibility and Benefit

ODJFS processes an unemployment compensation claim in two steps. First, it decides whether the claimant qualifies for benefits. To qualify, the claimant must have worked a certain number of weeks in covered employment and have lost his or her job for qualifying reasons, such as a layoff for lack of work or a reduction in force. Ohio Administrative Code Section 4141-27-01 contains the specific qualification rules.

Severance Pay Can Reduce the Amount of the Weekly Unemployment Compensation Benefit

ODJFS treats severance pay as earnings for the weeks in which it is received and will reduce unemployment compensation benefits accordingly. Specifically, Ohio Revised Code Section 4141.31 states:

Lump sum Severance Payments

Unless an employer allocates a lump sum severance payment to a period of time other than a benefit week, such as the employee’s last day of work, then Ohio law allows ODJFS to treat it as received during the period covered by the severance pay. For example, if a severance agreement stated that the employee shall receive $X as a severance payment for Y weeks, then ODJFS can divide X by Y to calculate the amount it will allocate as income for each week. If the amount exceeds the unemployment compensation benefit amount, the unemployment compensation benefit can be reduced to $0.

How to Claim Unemployment Benefits in Wisconsin

Regardless of what state you reside, there are certain guidelines that you may pursue when filing for unemployment. In case you have lately lost your job—be it a lay off or if you were fired – you might be entitled for unemployment benefits. In the state of Wisconsin, one of the easiest and fastest ways to file is by doing it online.

Wisconsin unemployment benefits offer short-term compensation to those workers meeting the eligibility requirements of Wisconsin law. The Wisconsin Department of Workforce Development manages its own unemployment insurance program within Federal rules.

There are a number of aspects to consider if you need unemployment insurance from the state of Wisconsin. You should study your eligibility, your weekly benefits and tax information before applying.

The value of unemployment benefits in Wisconsin varies from that of other states because each state unemployment office applies its own limits and formula when computing the level of unemployment compensation. The period of unemployment benefits in Wisconsin may also vary from that other states.

Eligibility Issues

Although a person has earned adequate wages during the base period, there are a number of factors that can lead to disqualification for unemployment in Wisconsin.

Applicants can be barred if they were fired from their most current employment for misconduct or excessive absenteeism. Eligibility issues also occur if a claimant abandons his or her job for no good reason, fails to make a suitable work search for a given claim week or works in excluded employment.

Excluded employment involves uncovered jobs such as working for a school while a student at that school and working for a family-owned business. Finally, working full time hours, or not being obtainable to work full-time hours, can also outcome in benefit disqualification.

When should I apply?

You must apply for jobless benefits by completing a first claim application in the first week for which you want to obtain an unemployment check or within 7 days of the end of that calendar week. If you wait to file your claim, you could lose benefits. You claim does not begin until you file your initial claim and benefits will not be paid for previous weeks.

An application must be made every time you want to begin collecting benefits. All claims based on work done in Wisconsin are filed either by online or by telephone, even if you reside in another state at present.

What Information Do I Need to Apply?

  1. Your Social Security Number
  2. A Personal Identification Number (PIN) which is a 4-digit number you frame before applying and it helps to identify you. The same PIN has to be used for all telephone and online unemployment services. Decide a PIN you will remember
  3. Your Wisconsin Driver s License Number
  4. The names of employers for whom you worked in the past 18 months
  5. For each employer you will also need, a full address (including zip code), a telephone number, the reason you are no longer working there and your first and last dates of work
  6. Your Alien Registration Number, if you are not a U.S. citizen.
  7. If a member of a skilled trades union, the name and local number of your union hall.
  8. Your Current Address. You need a valid mailing address to receive important documents about your claim. Make sure you have notified your post office of any recent changes to your address.

Federally funded and governed US welfare began in the 1930’s during the Great Depression. The US government responded to the overwhelming number of families and individuals in need of aid by creating a welfare program that would give assistance to those who had little or no income.

The US welfare system stayed in the hands of the federal government for the next sixty-one years. Many Americans were unhappy with the welfare system, claiming that individuals were abusing the welfare program by not applying for jobs, having more children just to get more aid, and staying unmarried so as to qualify for greater benefits. Welfare system reform became a hot topic in the 1990’s. Bill Clinton was elected as President with the intention of reforming the federally run US Welfare program. In 1996 the Republican Congress passed a reform law signed by President Clinton that gave the control of the welfare system back to the states.

The Federal government provides assistance through TANF (Temporary Assistance for Needy Families). TANF is a grant given to each state to run their own welfare program. To help overcome the former problem of unemployment due to reliance on the welfare system, the TANF grant requires that all recipients of welfare aid must find work within two years of receiving aid, including single parents who are required to work at least 30 hours per week opposed to 35 or 55 required by two parent families. Failure to comply with work requirements could result in loss of benefits.

Types of Welfare Available

The type and amount of aid available to individuals and dependent children varies from state to state. When the Federal Government gave control back to the states there was no longer one source and one set of requirements. Most states offer basic aid such as health care, food stamps, child care assistance, unemployment, cash aid, and housing assistance.

How to Apply for a Welfare Program

To apply for a welfare program, use the category search tool at the top of this page. Please read each program description carefully for the required documentation. Your process will always be smoother if you are well prepared. If you are going to meet in person, ask your case worker for a list of required documents needed at the appointment. Common documents asked for are proof of income, ID, and utility bills or other proof of residency.

Criminal Cases that depend on how you count

In Wisconsin all drunk driving charges after the first one are criminal charges handled in Circuit Court. First offense cases are not charged as crimes unless there is a minor in the car or there is an injury. Both criminal and civil drunk driving charges can have profound consequences. This page is about what counts and does not count as a prior conviction. It may surprise you.

Which things are counted as prior offenses is listed, confusingly, in Sec. 343.307, Wisconsin Statutes. Penalties (and classification as non-criminal/misdemeanor/felony) is determined by the penalty provisions in Sec. 346.65, Wisconsin Statutes .

Further, the timing and sequence of arrests and convictions can matter.

Civil Cases – First Offense

First Offense OWI / DUI is not treated as a crime in Wisconsin unless there is a child in the vehicle or someone is injured. That does not mean it is treated lightly. First offense OWI / DUI in Wisconsin often results in more significant penalties than in other states that treat this as a crime. However, the procedures are a little different in non-criminal cases and many different courts can hear such cases. If you have never been arrested or cited or in court for an OWI / DUI / Drunk Driving you are treated as a first offender. Except if as an underage drinker you were convicted of an absolute sobriety violation in another state that will count as a prior conviction.

Any one incident more than ten years ago will not count, but more than one will count. That is if a driver had one prior in May of 1989 a charge in June of 1999 (or 2010) counted as first offense. However if the driver had the May 1989 and the June 1999 offenses (both treated as first offenses) and then another in 2010, the 2010 charge would not be a first offense or second offense but a criminal third offense for court purposes. Again, you can have two first offenses more than ten years apart but not three. The look-back period for a any offense after the second is January 1, 1989. The look-back period to determine if a second actual offense is charged as a second offense is ten years, date of offense to date of offense.

No offenses before January 1, 1989 are counted.

Out of State Charges Are Different – Usually in a bad way!

The following are counted as prior convictions in Wisconsin when they occurred in a different state – even if they would not count in the original state:

  1. Refusing to take a chemical test
  2. A deferred prosecution for OWI / DUI / Drunk Driving / Drugged Driving that did not result in a conviction
  3. Operating as an underage drinker you were convicted of an absolute sobriety violation (would not count if in Wisconsin)
  4. A conviction for OWI / DUI / Drunk Driving / Drugged Driving

Some offenses in or out of Wisconsin are not counted!

Some prior convictions are not counted if proper procedures were not followed. This is a complex determination and requires analysis of all relevant records by an experienced attorney. For instance in one of the cases handled by our office a case originally charged as a third offense was properly revised to be a first offense.

Examples of counting

Example 1 – 3rd offense following two first offenses

Fifth Offense – Felony

Note, this is the same as example 6 except for the date of the second offense and conviction. The fourth offense conviction (third charged) was within 5 years of the second offense and the offense was within 5 years following the second offense conviction. The fourth charge was counted as a third because at the date of conviction there were only two earlier convictions. The third charge was counted as a fourth because at the date of conviction there were three convictions counted.

Example 8 – Out-of-state deferral without conviction

Note: State v. Carter . 2010 WI 132 (Dec. 2, 2010) decided saying that the Illinois absolute sobriety suspension counts as a prior offense. This does not necessarily apply to all out-of-state absolute sobriety convictions. Read the case!

IID Requirement (Ignition Interlock Device) – one more wrinkle on counting

Repeat Offenses

An IID is required for all second or subsequent offenses, even if the offense would be counted as a first offense for other penalty purposes. Village of Grafton v. Seatz . 2014 WI App 23 (Jan. 29, 2014). But, see DMV OWI Penalty Chart .

This is true even if none of the offenses involved alcohol. (No one ever said that the laws had to make sense.)

More Serious First Offenses

If there is an alcohol level of .15 or higher (at the time of the offense). Note: The alcohol reading on the evidentiary breath test may be higher than the alcohol level was at the time of the offense! Also, these machines are not calibrated to measure at the .15 level. Talk to a drunk driving defense lawyer!

If there was an unlawful refusal to take an evidentiary test that is specified in the Wisconsin Implied Consent law.

Can last longer than the revocation even if ordered for the same length of time – usually will last longer!

If an 18-month revocation period and an 18-month IID requirement are both imposed, do they end at the same time? Usually not. The revocation period gives credit for any period of administrative suspension (up to six months). In addition, the revocation period runs out once the time is up. The IID requirement does not start running until the driver has a license (occupational or regular).

Applies to all cars owned or driven, whether or not an owned car can even run!

If the DMV has record of the driver owning a vehicle, even if it has been junked or is undrivable, the driver will be required by the DMV to install an IID in it unless the vehicle is exempted by the Court.
