Filing a Claim

What to Wait for after you File Your Unemployment Claim?

About a week after applying, you will obtain a letter stating if you are eligible and, if so, how much you will collect weekly as your benefit. In case you do not qualify for benefits, the letter will clarify why and tell you what you must do if you wish to appeal the verdict.

Once you have qualified to collect benefits, you must claim your weekly benefits every 2 weeks. The initial letter you obtain will give you a date on which you must call or go online and answer a few questions about your continued eligibility. Failure to reclaim your benefits every two weeks will hold up the payment of benefits to you.

Moreover, in the state of Florida, the first week of unemployment is not considered eligible for unemployment benefits. Tips for Using the Unemployment Web Portal

  1. You should only create one portal account. If you have already gone through the steps to open an account, be sure you have checked your email to activate your account by following the directions before starting to create an account again.
  2. The system will give you three tries to type in your correct email and password. After the third unsuccessful attempt, the system will lock you out for 24 hours. After two tries, click the link for either Forgot your email? or Forgot your password? and follow the directions. This will prevent your account from locking you out.
  3. Do not use a false email address. You MUST have access to a valid email address in order to activate your account by going to the email address that you used to create the portal account and then following directions to validate the account. The Department of Labor will not provide your email address to any third party.
  4. Each person filing for a portal account must have his or her own email address.
  5. A new portal account needs to be set up even if you have used the previous unemployment web claims system.
  6. Your Maine JobLink account is different than your unemployment web portal account, the JobLink login will not work on the web portal. Note, however, that your unemployment client ID will be the same in Maine JobLink.
  7. If you call for customer assistance, be sure to let the person who answers the phone know which account you are calling about to make sure you are speaking to the correct staff person who can help you. We may refer you to other staff.
  8. You may file an initial claim for unemployment benefits if you do not have a Maine JobLink account. If you do so, the information from your initial claim will be used to initiate an account on Maine JobLink. However, before filing a weekly claim for benefits, you must activate and complete your Maine JobLink account. If you reside outside of Maine, you must be registered with the state JobLink of the state where you reside.
  9. If you have used an account on the Department of Labor’s previous job board system, the Maine Job Bank, that account will have transferred to Maine JobLink. Information about accessing your account is here. You will need to log in, activate it and complete any missing information before filing a weekly claim. Be sure to include your Social Security Number before filing any unemployment claim (initial or re-opening a benefit year) so that the unemployment system can match your existing account and you will avoid the system creating a second account for you.

    Establishing a New Claim

    If you become unemployed and have worked in Vermont anytime in the past 18 months, you may be eligible to receive unemployment insurance.

    Once you become totally or partially unemployed, the time to establish a new claim is during the first week you work less than 35 hours.

    Collecting Unemployment Benefits in Georgia

    In Georgia– as in every other state — employees who are temporarily out of work through no fault of their own may qualify for unemployment benefits. The eligibility rules, prior earnings requirements, benefit amounts, and other details vary from state to state. Here are the basic rules for collecting unemployment compensation in Georgia.

    In Georgia, the Department of Labor handles unemployment benefits and determines eligibility on a case-by-case basis. Applicants must meet the following three eligibility requirements in order to collect unemployment benefits in Georgia:

    Your past earnings must meet certain minimum thresholds.

    You must be unemployed through no fault of your own, as defined by Georgia law.

    You must be able and available to work, and you must be actively seeking employment.

    Past Earnings

    Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment. (For more information, see Nolo’s article, Unemployment Compensation: Understanding the Base Period). In Georgia, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your benefits claim. For example, if you filed your claim in October of 2013, the base period would be from June 1, 2012, through May 31, 2013.

    During the base period, you must meet all of the following requirements in order to be eligible for unemployment:

    • You must have earned wages in at least two quarters during the base period.
    • You must have earned at least $1,134 in wages during the two quarters of your base period in which you earned the highest wages.
    • Your total wages during the base period must be at least 1.5 times the wages you earned in the highest quarter of your base period.

    Reasons for Unemployment

    You must be out of work through no fault of your own to qualify for unemployment benefits.

    Layoffs. If you were laid off, lost your job in a reduction-in-force (RIF), or got “downsized” for economic reasons, you will still meet this requirement.

    Firing. If you were fired because you lacked the skills to perform the job or simply weren’t a good fit, you won t necessarily be barred from receiving benefits. However, if you engaged in misconduct, you will not be eligible to receive unemployment. In Georgia, among other things, misconduct means an intentional violation of the employer s rules, the failure to conform to standards which an employer can reasonably expect from an employee, or careless behavior that is so frequent or severe that it shows a disregard for the employer s interests. For example, showing up to work under the influence of alcohol or drugs or having several unexcused absences after written warning would typically qualify as misconduct.

    Quitting. If you quit your job, you won’t be eligible for unemployment benefits unless you had a good work-related reason for quitting. In general, you will have a good work-related reason if there was a material change to your working conditions, a material change to your work agreement with your employer, or your employer failed to pay you for your work. A personal reason for quitting, no matter how compelling, will not satisfy this requirement.

    Availability to Work

    To maintain your eligibility for unemployment benefits, you must be able to work, available to accept a job, and looking for employment. (For more information, see Nolo’s article, Collecting Unemployment: Are You Able, Available, and Actively Seeking Work?) If you re offered a suitable position, you must accept it. For the initial unemployment period, whether a position is suitable depends on several factors, including the level of skill and training required, the similarity between the work and your previous employment, how much the position pays, and the distance between the job site and your residence. However, after ten weeks of collecting unemployment, you will be expected to accept a position that pays at least 66% of the average hourly wage you earned during the highest quarter of your base period (provided that it is at least minimum wage).

    You must conduct a reasonable search for work, which includes contacting at least three new job contacts each week. You should keep a record of your job search efforts, including the employers you have contacted, the dates you made contact, and the outcome. The Georgia Department of Labor (GDOL) may contact you or your employer contacts to verify your efforts.

    Amount and Duration of Unemployment Benefits in Georgia

    Your weekly benefit amount is calculated by combining your wages from the two highest quarters in your base period, and dividing that number by 42. Your weekly benefit amount is subject to a weekly minimum of $44 and a maximum of $330. Benefits are available for up to 20 weeks.

    How to File a Claim for Unemployment Benefits in Georgia

    You may file your claim for unemployment benefits in-person at a GDOL Career Center or online. You can find online filing information and contact information at http://www.dol.state.ga.us/js/. Once you file, you must continue to file weekly claims with the GDOL for each week for which you are claiming benefits.

    Once it receives your application, the GDOL will send you some documents, including a Benefit Determination, stating your potential benefit amount and duration. You ll also receive a Claims Examiner s Determination, which lets you know whether the reason for leaving your job meets state eligibility requirements.

    How to Appeal a Denial of Unemployment Benefits in Georgia

    If your claim for unemployment is denied, you have 15 days to appeal the decision with the Appeals Tribunal. Your request for appeal must be in writing (letter format is fine) and mailed or faxed to a GDOL Career Center.

    The purpose of unemployment insurance is to provide workers, who are unemployed through no fault of their own, with monetary payments for a specific period of time or until the worker finds a new job.

    Unemployment benefits are provided by state unemployment insurance programs within guidelines established by Federal law. Eligibility for unemployment insurance, benefit amounts and the length of time benefits are available are determined by state law.

    State Unemployment Benefits

    Eligibility for unemployment insurance, benefit amounts and the length of time benefits are available are determined by state law and vary depending on where you live. Information on eligibility for state unemployment compensation is available on the state unemployment office website for your state.

    The unemployment compensation you will receive will depend upon the amount you earned while working. In addition, there are eligibility requirements to qualify for unemployment benefits including working a certain number of weeks.

    Regular unemployment benefits are paid for a maximum of 26 weeks, less in some states. In many states, the compensation will be half your earnings, up to a maximum amount. The maximum varies by location.

    Federal Unemployment Benefits

    There are no federal unemployment benefit programs in effect. Those benefits, known as an unemployment extension, provided additional weeks of unemployment compensation for the long-term unemployed.

    Extended unemployment benefits, including Emergency Unemployment Compensation (EUC) and Extended Benefit (EB) programs were available to workers who had exhausted regular state unemployment insurance benefits during periods of high unemployment prior to 2014.

    Unemployment Eligibility

    In order to receive unemployment compensation, workers must meet the unemployment eligibility requirements for wages earned or time worked during an established (one year) period of time.

    In addition, workers must be determined to be unemployed through no fault of their own.

    Disqualification from Unemployment

    The following circumstances may disqualify you from collecting unemployment benefits, depending on state law:

    • Quit without good cause
    • Fired for misconduct
    • Resigned because of illness (check on disability benefits)
    • Left to get married
    • Self-employed
    • Involved in a labor dispute
    • Attending school

    Unemployment Benefits

    • Regular benefits are paid for a maximum of 26 weeks in most states. Some states provide benefits for fewer weeks.
    • In many states, the compensation will be half your earnings, up to a maximum amount.
    • Benefits are subject to Federal income taxes and must be reported on your Federal income tax return.

    When to File

    Filing for unemployment should be the first item on your agenda when you ve been laid off. It might take two or three weeks to collect a check, so the sooner you file, the faster you ll get paid. A delay in filing will mean a delay in collecting.

    Unemployment When You Quit

    Can you collect unemployment if you quit your job? It depends. In most cases, if you voluntarily left employment you are not eligible. However, if you left for good cause you may be able to collect.

    Good cause would be determined by the state unemployment office and you will be able to make a case for why you are eligible for benefits. If your claim is denied, you should be entitled to a hearing where you can plead your case.

    A quick and easy way to find a telephone number or email address for your unemployment office is to search Google using your state s name, unemployment office and phone number.     If English is not your first language, some states have telephone claims lines in other languages.     DES MOINES, Iowa (KCRG-TV) — A 55-year-old Williamsburg man will serve a total of 100 days in jail for fraudulently receiving $10,747 of Iowa Unemployment Insurance benefits between December 27, 2015 and June 25, 2016.

    Paul Meade has been convicted of fraudulent practice in the third degree, an aggravated misdemeanor.

    “Pursuing those who claim benefits fraudulently is part of our ongoing effort to prevent fraud, waste and abuse,” said Beth Townsend, Director of Iowa Workforce Development. “Our goal is to recover misused funds, maintain the integrity of the unemployment insurance trust fund, and send the message that fraud will not be tolerated.”

    During the time Meade was filing for unemployment insurance benefits, he was also receiving wages from Whirlpool Corporation. Meade’s case was turned over to the Iowa County Attorney’s Office in February 2017. The total amount Meade will repay Iowa Workforce Development is $12,359.05. Per Iowa Code 96.16-4(b), a 15 percent penalty was added in the amount of $1,612.05.

    “This is a big win,” said David Steen, an attorney with Iowa Workforce Development. “With this sentence including jail time, this might make others think twice before fraudulently claiming unemployment insurance benefits.”

    “It’s important to hold Iowans abusing the system accountable,” said Ryan West, the Unemployment Insurance Division Administrator for Iowa Workforce Development. “Committing fraud means a financial burden is placed elsewhere which is not fair to other law abiding citizens.”

    The amount paid will be added to Iowa’s unemployment compensation trust fund. “Deposits to the trust fund benefit employers,” said West. “It maintains the trust fund solvency, which in turn helps Iowa employers by maintaining a lower unemployment insurance tax rate.”

    Collecting Unemployment Benefits in Georgia

    In Georgia– as in every other state — employees who are temporarily out of work through no fault of their own may qualify for unemployment benefits. The eligibility rules, prior earnings requirements, benefit amounts, and other details vary from state to state. Here are the basic rules for collecting unemployment compensation in Georgia.

    In Georgia, the Department of Labor handles unemployment benefits and determines eligibility on a case-by-case basis. Applicants must meet the following three eligibility requirements in order to collect unemployment benefits in Georgia:

    Your past earnings must meet certain minimum thresholds.

    You must be unemployed through no fault of your own, as defined by Georgia law.

    You must be able and available to work, and you must be actively seeking employment.

    Past Earnings

    Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment. (For more information, see Nolo’s article, Unemployment Compensation: Understanding the Base Period). In Georgia, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your benefits claim. For example, if you filed your claim in October of 2013, the base period would be from June 1, 2012, through May 31, 2013.

    During the base period, you must meet all of the following requirements in order to be eligible for unemployment:

    • You must have earned wages in at least two quarters during the base period.
    • You must have earned at least $1,134 in wages during the two quarters of your base period in which you earned the highest wages.
    • Your total wages during the base period must be at least 1.5 times the wages you earned in the highest quarter of your base period.

    Reasons for Unemployment

    You must be out of work through no fault of your own to qualify for unemployment benefits.

    Layoffs. If you were laid off, lost your job in a reduction-in-force (RIF), or got “downsized” for economic reasons, you will still meet this requirement.

    Firing. If you were fired because you lacked the skills to perform the job or simply weren’t a good fit, you won t necessarily be barred from receiving benefits. However, if you engaged in misconduct, you will not be eligible to receive unemployment. In Georgia, among other things, misconduct means an intentional violation of the employer s rules, the failure to conform to standards which an employer can reasonably expect from an employee, or careless behavior that is so frequent or severe that it shows a disregard for the employer s interests. For example, showing up to work under the influence of alcohol or drugs or having several unexcused absences after written warning would typically qualify as misconduct.

    Quitting. If you quit your job, you won’t be eligible for unemployment benefits unless you had a good work-related reason for quitting. In general, you will have a good work-related reason if there was a material change to your working conditions, a material change to your work agreement with your employer, or your employer failed to pay you for your work. A personal reason for quitting, no matter how compelling, will not satisfy this requirement.

    Availability to Work

    To maintain your eligibility for unemployment benefits, you must be able to work, available to accept a job, and looking for employment. (For more information, see Nolo’s article, Collecting Unemployment: Are You Able, Available, and Actively Seeking Work?) If you re offered a suitable position, you must accept it. For the initial unemployment period, whether a position is suitable depends on several factors, including the level of skill and training required, the similarity between the work and your previous employment, how much the position pays, and the distance between the job site and your residence. However, after ten weeks of collecting unemployment, you will be expected to accept a position that pays at least 66% of the average hourly wage you earned during the highest quarter of your base period (provided that it is at least minimum wage).

    You must conduct a reasonable search for work, which includes contacting at least three new job contacts each week. You should keep a record of your job search efforts, including the employers you have contacted, the dates you made contact, and the outcome. The Georgia Department of Labor (GDOL) may contact you or your employer contacts to verify your efforts.

    Amount and Duration of Unemployment Benefits in Georgia

    Your weekly benefit amount is calculated by combining your wages from the two highest quarters in your base period, and dividing that number by 42. Your weekly benefit amount is subject to a weekly minimum of $44 and a maximum of $330. Benefits are available for up to 20 weeks.

    How to File a Claim for Unemployment Benefits in Georgia

    You may file your claim for unemployment benefits in-person at a GDOL Career Center or online. You can find online filing information and contact information at http://www.dol.state.ga.us/js/. Once you file, you must continue to file weekly claims with the GDOL for each week for which you are claiming benefits.

    Once it receives your application, the GDOL will send you some documents, including a Benefit Determination, stating your potential benefit amount and duration. You ll also receive a Claims Examiner s Determination, which lets you know whether the reason for leaving your job meets state eligibility requirements.

    If your claim for unemployment is denied, you have 15 days to appeal the decision with the Appeals Tribunal. Your request for appeal must be in writing (letter format is fine) and mailed or faxed to a GDOL Career Center.

The amount of money you will receive each unemployment claim week will vary, depending on how much money you have earned at your current position. As of 2011, you will receive between $32 and $275 per unemployment claim week. The only way to receive unemployment benefits through the FLUID system is to file an initial claim, and then file for each of the claim weeks you are unemployed. You can apply for unemployment in Florida online, using the online FLUID system.

    File an initial claim

    To begin receiving unemployment compensation from the state of Florida, you will need to file an initial claim. Visit the FLUID online system and fill out the requested information. You will need to provide your personal information, including your name, address and social security number. You will also need to supply the name and address of your employer and information about the amount of time you worked and the income you have earned. You can find most of your employer information on your paystub. Allow about an hour to file your initial FLUID claim.

The only way to receive unemployment benefits is to file a weekly FLUID claim; it is essential to file your claim each time you are supposed to. Delays in completing the weekly FLUID claim will cause payment delays as well.

    Eligibility

    Your eligibility to receive unemployment compensation will be determined after your initial claim is filed. You will also need to confirm your availability and willingness to work as part of your weekly claims to continue to be eligible for benefits.

    In most cases, you will be approved for unemployment in Florida, provided that you worked for enough weeks in the period before you lost your job, you earned enough income in that job, and you lost your job through no fault of your own.     Severance pay in Ohio can reduce or eliminate an employee’s unemployment compensation benefits for the weeks that the severance pay is received. If an employer pays severance pay in a lump sum, the Ohio Department of Jobs and Family Services (ODJFS) can allocate the lump sum severance payment to the period of unemployment that it covers and reduce unemployment compensation benefits for those weeks.

    Unemployment Compensation Eligibility and Benefit

    ODJFS processes an unemployment compensation claim in two steps. First, it decides whether the claimant qualifies for benefits. To qualify, the claimant must have worked a certain number of weeks in covered employment and have lost his or her job for qualifying reasons, such as a layoff for lack of work or a reduction in force. Ohio Administrative Code Section 4141-27-01 contains the specific qualification rules.

    Severance Pay Can Reduce the Amount of the Weekly Unemployment Compensation Benefit

    ODJFS treats severance pay as earnings for the weeks in which it is received and will reduce unemployment compensation benefits accordingly. Specifically, Ohio Revised Code Section 4141.31 states:

    Lump sum Severance Payments

For example, if a severance agreement stated that the employee shall receive $X as a severance payment for Y weeks, then ODJFS can divide X by Y to calculate the amount it will allocate as income for each week. If the amount exceeds the unemployment compensation benefit amount, the unemployment compensation benefit can be reduced to $0.
