New California Transfer On Death Deed

There are several ways an owner of real property can direct the transfer of real property when they die. Up until recently, the most common way was through a trust, will or owning the property in joint tenancy with another person or persons. Effective January 1, 2016, there is now a new way California allows real property to be transferred upon a person’s death and avoid probate.

Governor Jerry Brown signed Assembly Bill 139 which established a procedure to transfer real property upon death through a revocable transfer on death deed. This revocable transfer on death deed is a new simple and inexpensive way to transfer real property to a beneficiary in California. The deed allows a person to leave their real property to a designated person or persons such as a family member, friend, life-long partner or other loved one, without having to set up a living trust.

Criteria For Transfer on Death Deed (TOD Deed)

The new TOD (transfer on death) deed allows an owner of residential real property to name one or more beneficiaries to receive the property when the owner dies, thus bypassing the need to probate the estate. There are some specific criteria, however, that a person should be aware of when considering recording a revocable transfer on death deed.

  • The real property must be a single family home or condominium unit, or a multiple residence of not more than 4 residential dwelling units, or be a single family residence on no more than 40 acres of agricultural land.
  • A revocable TOD deed must be signed and dated before a notary public to be effective and valid.
  • The transfer on death deed must be recorded within 60 days or less from the date it is signed.
  • The transfer on death deed can be revoked by the transferor at any time.

A Transfer On Death Deed may be a great option for a person whose only asset is the home in which he or she lives.

Revoking a Transfer on Death Deed

There are three ways the transferor/owner can revoke a transfer on death deed.

  1. The owner can record a formal notice of revocation.
  2. A new transfer on death deed may be recorded.
  3. The real property can be transferred to someone else prior to the transferor s death.

Although the transfer on death deed must be recorded within 60 days or less from the date it is it signed and before the owner s death, it is important to understand that the interest in the real estate only transfers when the owner dies. This means that the beneficiary identified on the TOD deed does not have any rights to the real property when the owner is alive. Furthermore, creditors of a named beneficiary cannot place any liens on the property. While the owner is living, the owner has the right to sell or encumber the property. The property is also subject to involuntary liens that may be recorded by creditors of the owner which would transfer with the property to the beneficiary upon the owner s death.

In theory, a person that owns real property in California could execute and record more than one revocable transfer on death deed. The new law provides that the deed with the most recent recording date will be the one in effect.

Transfer on Death Deeds and Joint Tenancy

If you co-own the property as joint tenancy or community property with right of survivorship, the other owner automatically receives your share of the property upon your death. The TOD deed has no effect unless you outlive the other joint tenant. In this regard, co-owners may consider signing separate TOD deeds if they both want the same beneficiaries after both die. A better solution, however, would be to set up a living trust.

Downsides to a Transfer on Death Deed

If the person named in the deed as the transfer on death beneficiary dies before the real property owner does, the deed simply has no effect. This could result in the property having to be probated.

If the owner becomes incapacitated through stoke, dementia, or other event, there may be no one to revoke the deed which may be necessary due to a change in family circumstances or the need to qualify the person for Medicaid assistance.

If the Transfer on Death deed is not timely recorded within the statutory deadline (60 days or less from the date it is signed) the TOD deed becomes invalid. We recently had this situation happen to an individual who was attempting to record TOD deeds rather that set up a living trust. The TOD deeds were prepared and, as they requested, we sent to them client so they could record them. Unbeknownst to anyone, the client failed to timely record the deeds and then within a very short period of time died. By the time it was realized by the beneficiary that they had not been recorded, the TOD deeds had became invalid. The estate is now having to be probated. For these reasons, Transfer on Death Deeds should only be used as a last resort if there is not sufficient time to prepare proper estate documents.

Trust vs. New Transfer on Death Deed

For people with very few assets, recording a Transfer on Death Deed may be a quick and easy fix to set up beneficiaries to real property and avoid probate as compared to setting up a revocable living trust. However, since this transfer on death deed only directs the transfer of real property, it is not a great solution for people or couples that have minor children or have other assets that would be better administered through a trust. Additionally, since the transfer is to specific beneficiaries, problems could arise if the named beneficiaries are no longer living. Lastly, a person or couple with minor children should not name their minor children on a TOD deed. Under California law, although a minor may own real property or an interest therein, they may not convey or make contracts relating to real property. Refer to California Family Code Section 6701 which provides that minors cannot enter into contracts relating to real property, or personal property not in their immediate possession and control, and they cannot give a delegation of power. California Civil Code § 1556 also provides that minors are incapable of contracting. Therefore, since a minor cannot sell or purchase property held directly in his or her own name, transactions involving a minor s interests in real property are best set up through a trust, custodian or guardian, for the benefit of a minor. The California Uniform Transfers to Minors Act (CUTMA) makes provision for the transfer of property to an adult custodian for the benefit of a minor. The custodian would then hold, control, manage, and invest the custodial property on behalf of the minor. When the custodianship terminates, title to the custodial property can then be transferred to the minor or the minor s estate.

In essence, a rent to own contract is created in which the tenant/buyer agrees to pay an installment payment in the form of rent, as specified in the contract for lease agreement. On the date for final payment in the rent to own agreement, the specified total purchase price will have been paid. When the agreement has been fulfilled, then the owner/landlord transfers a quit claim deed or warranty deed to the buyer/tenant.

If the buyer fails to complete the terms of the agreement, there may be forfeiture of the payments made. However, the buyer and seller may include terms in a contract for lease agreement for handling late payments to avoid forfeiture of the buyer’s equity. The local real estate recorder’s office should be contacted for information and policies for filing purchase contracts for rent to own homes.

When the buyer’s payment is past due on a land installment sales contract, the seller has the right to enforce the lease agreement. It will be a matter of determination for the court based on the facts in each purchase agreement. The court may either:

  • Strictly uphold the terms of the agreement, making the buyer vacate the property, allowing forfeiture of the buyer/tenant’s equity in the property.
  • Declare the buyer in default, but give the buyer a deadline to cure the default and pay off the balance owed or vacate.
  • Declare forfeiture unfair and make the seller return part or all of the installment payments made under the purchase contract for the house.
  • Interpret the agreement as really being a mortgage, and force the seller to bring a foreclosure action.
  • Deny the forfeiture and reinstate the rent to own agreement.

New California Transfer On Death Deed

There are several ways an owner of real property can direct the transfer of real property when they die. Up until recently, the most common way was through a trust, will or owning the property in joint tenancy with another person or persons. Effective January 1, 2016, there is now a new way California allows real property to be transferred upon a person’s death and avoid probate.

Governor Jerry Brown signed Assembly Bill 139 which established a procedure to transfer real property upon death through a revocable transfer on death deed. This revocable transfer on death deed is a new simple and inexpensive way to transfer real property to a beneficiary in California. The deed allows a person to leave their real property to a designated person or persons such as a family member, friend, life-long partner or other loved one, without having to set up a living trust.

Criteria For Transfer on Death Deed (TOD Deed)

The new TOD (transfer on death) deed allows an owner of residential real property to name one or more beneficiaries to receive the property when the owner dies, thus bypassing the need to probate the estate. There are some specific criteria, however, that a person should be aware of when considering recording a revocable transfer on death deed.

  • The real property must be a single family home or condominium unit, or a multiple residence of not more than 4 residential dwelling units, or be a single family residence on no more than 40 acres of agricultural land.
  • A revocable TOD deed must be signed and dated before a notary public to be effective and valid.
  • The transfer on death deed must be recorded within 60 days or less from the date it is signed.
  • The transfer on death deed can be revoked by the transferor at any time.

A Transfer On Death Deed may be a great option for a person whose only asset is the home in which he or she lives.

Revoking a Transfer on Death Deed

There are three ways the transferor/owner can revoke a transfer on death deed.

  1. The owner can record a formal notice of revocation.
  2. A new transfer on death deed may be recorded.
  3. The real property can be transferred to someone else prior to the transferor s death.

Although the transfer on death deed must be recorded within 60 days or less from the date it is it signed and before the owner s death, it is important to understand that the interest in the real estate only transfers when the owner dies. This means that the beneficiary identified on the TOD deed does not have any rights to the real property when the owner is alive. Furthermore, creditors of a named beneficiary cannot place any liens on the property. While the owner is living, the owner has the right to sell or encumber the property. The property is also subject to involuntary liens that may be recorded by creditors of the owner which would transfer with the property to the beneficiary upon the owner s death.

In theory, a person that owns real property in California could execute and record more than one revocable transfer on death deed. The new law provides that the deed with the most recent recording date will be the one in effect.

Transfer on Death Deeds and Joint Tenancy

If you co-own the property as joint tenancy or community property with right of survivorship, the other owner automatically receives your share of the property upon your death. The TOD deed has no effect unless you outlive the other joint tenant. In this regard, co-owners may consider signing separate TOD deeds if they both want the same beneficiaries after both die. A better solution, however, would be to set up a living trust.

Downsides to a Transfer on Death Deed

If the person named in the deed as the transfer on death beneficiary dies before the real property owner does, the deed simply has no effect. This could result in the property having to be probated.

If the owner becomes incapacitated through stoke, dementia, or other event, there may be no one to revoke the deed which may be necessary due to a change in family circumstances or the need to qualify the person for Medicaid assistance.

If the Transfer on Death deed is not timely recorded within the statutory deadline (60 days or less from the date it is signed) the TOD deed becomes invalid. We recently had this situation happen to an individual who was attempting to record TOD deeds rather that set up a living trust. The TOD deeds were prepared and, as they requested, we sent to them client so they could record them. Unbeknownst to anyone, the client failed to timely record the deeds and then within a very short period of time died. By the time it was realized by the beneficiary that they had not been recorded, the TOD deeds had became invalid. The estate is now having to be probated. For these reasons, Transfer on Death Deeds should only be used as a last resort if there is not sufficient time to prepare proper estate documents.

Trust vs. New Transfer on Death Deed

For people with very few assets, recording a Transfer on Death Deed may be a quick and easy fix to set up beneficiaries to real property and avoid probate as compared to setting up a revocable living trust. However, since this transfer on death deed only directs the transfer of real property, it is not a great solution for people or couples that have minor children or have other assets that would be better administered through a trust. Additionally, since the transfer is to specific beneficiaries, problems could arise if the named beneficiaries are no longer living. Lastly, a person or couple with minor children should not name their minor children on a TOD deed. Under California law, although a minor may own real property or an interest therein, they may not convey or make contracts relating to real property. Refer to California Family Code Section 6701 which provides that minors cannot enter into contracts relating to real property, or personal property not in their immediate possession and control, and they cannot give a delegation of power. California Civil Code § 1556 also provides that minors are incapable of contracting. Therefore, since a minor cannot sell or purchase property held directly in his or her own name, transactions involving a minor s interests in real property are best set up through a trust, custodian or guardian, for the benefit of a minor. The California Uniform Transfers to Minors Act (CUTMA) makes provision for the transfer of property to an adult custodian for the benefit of a minor. The custodian would then hold, control, manage, and invest the custodial property on behalf of the minor. When the custodianship terminates, title to the custodial property can then be transferred to the minor or the minor s estate.

By more than one (1) individual or entity, there are three (3) types of ownership interest in property:

Joint Tenants (Rights of Survivorship) If one (1) of the Spouses were to die then the other Spouse would obtain their ownership interest in the Property.

Tenants in Common Spouses are allowed to sell their ownership interest without the approval of the other and if one (1) of the Spouses were to die the ownership of the property would transfer to the Heirs listed in their Last Will and Testament.

Tenants by the Entirety Does not allow one (1) Spouse to sell their interest in the property without the other s consent.

Collecting Unemployment Benefits in Nevada

Did you recently lose your job in Nevada? If so, you might be eligible for unemployment benefits: compensation available to employees who are temporarily out of work through no fault of their own. Although the basic rules for unemployment are similar across the board, the eligibility rules, prior earnings requirements, benefit amounts, and other details vary from state to state. Below you ll find information on collecting unemployment in Nevada.

In Nevada, the Department of Employment, Training, and Rehabilitation (DETR) handles unemployment benefits and determines eligibility on a case-by-case basis. Applicants must meet the following three eligibility requirements in order to collect unemployment benefits in Nevada:

You must have earned at least a minimum amount in wages before you were unemployed.

You must be unemployed through no fault of your own, as defined by Nevada law.

You must be able and available to work, and you must be actively seeking employment.

Past Earnings

Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment. (For more information, see Nolo’s article, Unemployment Compensation: Understanding the Base Period). In Nevada, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your benefits claim. For example, if you file your claim in June of 2015, the base period would be from April 1, 2014, through March 31, 2015.

To qualify for benefits in Nevada, you must have earned at least $400 during your highest paid quarter of the base period. In addition, you must meet one of the following two requirements:

Your total earnings during the base period must be at least one-and-a-half times your earnings during the highest paid quarter.

You must have earned some wages in at least three of the four quarters of the base period.

Reasons for Unemployment

In Nevada, as in other states, you must be out of work through no fault of your own to qualify for unemployment benefits.

Layoffs. If you were laid off, lost your job in a reduction-in-force (RIF), or got “downsized” for economic reasons, you will meet this requirement.

Firing. If you were fired because you lacked the skills to perform the job or simply weren’t a good fit, you won t necessarily be barred from receiving benefits. However, if you were fired for misconduct relating to your job, you won t be eligible for benefits. If, for example, you deliberately disregarded your employer s reasonable rules or policies, or you were so careless on the job as to demonstrate a substantial disregard of your employer s interests or your job duties, you will be disqualified. You will be disqualified for a longer time period if you were fired for criminal activity in connection with your job.

Quitting. If you quit your job, you won’t be eligible for unemployment benefits unless you had good cause. In general, good cause means that your reason for leaving the position was job-related and was so compelling that you had no other choice than to leave. For example, if you left your job because of dangerous working conditions or sexual harassment that your employer refused to stop, you may be able to collect benefits. You may also remain eligible for benefits if you quit because of your own health problems, to care for a seriously ill family member, or to relocate with a spouse, depending on the circumstances.

Availability to Work

To keep collecting unemployment benefits, you must be able to work, available to work, and looking for employment. (For more information, see Nolo’s article, Collecting Unemployment: Are You Able, Available, and Actively Seeking Work?) If you re offered a suitable position, you must accept it.

Whether a position is suitable depends on several factors, including the skill and training required, how much the job pays, how similar the job is to your former employment, and how far you will have to commute to work if you take the job. However, as time goes on, you will be expected to modify your standards and consider accepting work that is different or that pays less than what you were receiving.

In Nevada, you will be considered available for work only if you don t have any restrictions preventing you from taking a job immediately, if one is offered. For example, you must be able to make arrangements for childcare and transportation.

Amount and Duration of Unemployment Benefits in Nevada

If you are eligible to receive unemployment, your weekly benefit rate (WBR) will be 4% of your total earnings during the highest paid quarter of the base period, subject to a minimum of $16 per week and a maximum of $407 per week (as of July 1, 2014). The maximum weekly benefit amount is 50% of the average weekly wage in Nevada, which is adjusted each July 1. You may receive benefits for a maximum of 26 weeks. (In times of very high unemployment, additional weeks of benefits may be available.)

How to File a Claim for Unemployment Benefits in Nevada

You may file your claim for unemployment benefits online or by phone. You can find online filing information, as well as regional telephone numbers for filing by phone, at the Department of Employment, Training, and Rehabilitation website.

Once the DETR receives your application, it will send you some documents, including a Monetary Determination indicating whether you met the initial earnings requirements to qualify for benefits.

How to Appeal a Denial of Unemployment Benefits in Nevada

If your unemployment claim is denied, you have 11 days to appeal the decision. After receiving your appeal request, the DETR will schedule a hearing before an appeals referee, at which you can present evidence and witnesses. You will receive notice of the hearing date, along with a pamphlet explaining the appeal process.

If you disagree with the referee s decision after the initial hearing, you can request an appeal by the Board of Review within 11 days. And, if you disagree with the Board s finding, you may file an appeal in court.

  • Removing A Cloud On Title For Title Insurance. In the process of insuring title to real estate title companies may find a cloud in the title. Generally this means that there appears to be someone may or may not have an interest in a property that has not been accounted for and it is causing a break in the chain of title. It is common for the company insuring the title to require the person in question to quit claim their interest in the property prior to issuing the title insurance.

While each County has specific formatting requirements for the recording of documents there are main elements that are common to all real estate deeds.

  • Title. The title of a legal document tells the world what type of document it is. In this case the title is Quit Claim Deed
  • Executed Date. This is the date that the legal document was completed, signed, and executed.
  • Grantor. This is the person or persons that is transferring their rights to the real estate to someone else. For the purpose of a quit claim deed the term person can refer to a natural person, an LLC, a Partnership, a Corporation, a Trust or Trustee, or any other entity that can legally own real estate.
  • Grantee. This is the person that is receiving the rights to the real estate that are being transferred. Again here, the term person refers to any entity that can legally own real estate.
  • Habendum. This is the meat of the deed, the legal speak which actually transfers the rights to the property. Generally it is a phrase similar to: . does hereby remise, release and quitclaim unto the said Grantee forever, all the right, title, interest and claim which the said Grantor has in and to the following described parcel of land, and improvements and appurtenances thereto.
  • Consideration. This is what the Grantee gives to the Grantor in return for the rights to the property. While in some cases a deed may be enforceable without consideration it certainly muddies the water. It s a good idea to check with a tax accountant before transferring real estate with a no consideration or gift deed as there may be tax issues.
  • Legal Description. Here is where the description of the property being transferred is listed. The format of the legal description varies from state to state. The types of legal descriptions are: metes and bounds, rectangular survey, and lot and block. The lot and block legal description is the most common however it depends on your state. A typical lot and block description looks like: QCD SUBDIVISION, 2ND AMD, LOT 112 BLOCK 3 .
  • Signatures. Most states require only the Grantor to sign the deed and for it to be delivered to the Grantee for it to be valid. Grantor s signatures usually must be notarized and in some rare cases separate witnesses must also witness the Grantor signing.
  • Prepared By. This section lets the world know who prepared the quit claim deed. Generally this is the Grantor or an attorney.

Introduction

If you have been wondering how to purchase a house but can’t qualify for a mortgage, a contract for deed may be right for you. A contract for deed is a lease of real property in which the payments can ultimately be applied to purchase of the property. The deed isn’t transferred until the agreed upon total payments have been made. Therefore, it is a form of seller financing, and rent paid may be thought of as installment payment toward purchase of the property. It is also referred to as a rent to own lease agreement or land contract.

How a Contract for Deed Works

If you own a home or other real estate that has been on the market a long time, or are looking for how to purchase a house but unable to get mortgage financing, a contract for deed may be what you need. In essence, a rent to own contract is created in which the tenant/buyer agrees to pay an installment payment in the form of rent, as specified in the contract for lease agreement. On the date for final payment in the rent to own agreement, the specified total purchase price will have been paid. When the agreement has been fulfilled, then the owner/landlord transfers a quit claim deed or warranty deed to the buyer/tenant.

If the buyer fails to complete the terms of the agreement, there may be forfeiture of the payments made. However, the buyer and seller may include terms in a contract for lease agreement for handling late payments to avoid forfeiture of the buyer’s equity. The local real estate recorder’s office should be contacted for information and policies for filing purchase contracts for rent to own homes.

When the buyer’s payment is past due on a land installment sales contract, the seller has the right to enforce the lease agreement. It will be a matter of determination for the court based on the facts in each purchase agreement. The court may either:

  • Strictly uphold the terms of the agreement, making the buyer vacate the property, allowing forfeiture of the buyer/tenant’s equity in the property.
  • Declare the buyer in default, but give the buyer a deadline to cure the default and pay off the balance owed or vacate.
  • Declare forfeiture unfair and make the seller return part or all of the installment payments made under the purchase contract for the house.
  • Interpret the agreement as really being a mortgage, and force the seller to bring a foreclosure action.
  • Deny the forfeiture and reinstate the rent to own agreement.

It is a seller financing method to sell property through making installment payments to the seller in the form of rent. Rent paid by the buyer is equivalent to installment payments on promissory notes, and the land contract form may also include a balloon payment. If the buyer has past due installment payments, how do I make them vacate the property?

The answer will depend on state law for contracts for deed. In some cases, if the rent to own contract is 5 years or longer, a foreclosure must be initiated. In other cases, the tenant must be evicted according to state landlord tenant laws. A court order for installment payments due may be requested if there is a breach of the contract for deed.

What happens if a buyer’s payments are past due?

Landlords/owners are entitled to enforce the purchase contract for homes. In some land contract forms, the landlord will include liquidated damages for past due payments. Often, forfeiture of the rent paid will be ordered and sellers will keep the homes. However, sometimes the buyer can cure the default and purchase the home if the remaining past and future amounts due are paid. The answer will depend on state law and whether the seller breached the lease agreement.

Who pays the mortgage on the property?

Usually, the mortgage will continue to be paid by the seller. In a seller financing situation such as in a contract for deed, the buyer under the contract for lease agreement makes installment payments to the seller. The seller, as owner, will continue to be named on and pay the mortgage. It is advised to check with the mortgage lender to verify whether a contract for deed will trigger a due on sale clause or not.

How long are installment payments made under an installment land contract?

The leasing term for a rent to own house is a matter of agreement between the parties. The typical owner of rent to own homes allows at least a few years to complete the purchase contract for the real estate involved. It is similar to promissory notes which have a starting and ending date for installment payments.

Regulations in the Nevada Title Loan Industry

LAS VEGAS. May 31, 2013 /PRNewswire-iReach/ — Short-term auto title loans for consumers with bad credit carry a stigma: They’re dangerous. They’ll create a bottomless pit of debt. The title loan will cost the borrower their car.

Is the stigma accurate? Sometimes it is. That’s why recent regulations imposed on the title loan industry are so important.

To date, the Nevada legislature has established consumer protections from predatory title loan companies in two different years, 2005 and 2007. Some highlights:

Lenders must be state-licensed.

How this protects the consumer: A state-licensed loan business is more credible, more responsible, and more accountable than an unlicensed entity.

Title loans must not extend past seven months, total. The maximum loan term is 30 days, renewable no more than six times.

How this protects the consumer: In a high-interest loan, time is money. A 300% APR loan can potentially repay itself three times every year, over and over. Nevada law caps the amount of time a loan can be extended, eliminating the ability of the loan company to trap consumers in an unescapable debt cycle.

The lender must give 30 days written notice prior to vehicle repossession.

How this protects the consumer: No vehicle repossession will be a surprise. Borrowers in default will have time to attempt the loan repayment or make alternative transportation plans.

In the event of a loan default, the lender can collect no more than the collateral vehicle as repayment for the loan.

How this protects the consumer: The lender is not allowed to pursue any other types of payment or assets beyond the vehicle itself. Once the vehicle is repossessed, the loan is ended, and the borrower is free from any further responsibility.

The lender can not offer a loan higher in value than the fair market value of the vehicle.

How this protects the consumer: A bigger loan means bigger payments, increasing the likelihood that the borrower will find themselves in default at some point during the course of the loan. This law also protects the lender; as the lender can not collect any payment beyond the vehicle itself in the event of a default, they are protected from overloaning themselves out of business.

The lender can not threaten a criminal process to collect on the loan.

How this protects the consumer: Title loan companies are not allowed aggressive collection practices. In a Nevada title loan, only the vehicle is at risk, not the borrower’s security, sanity, or health.

Nevada still allows lenders some freedoms most other states do not. Nevada does not cap the amount of interest that can be charged per title loan, counting on the protections of time limits and collections policies to guard consumers.

In all business, some companies strive to keep customers happy, while other strive to squeeze out whatever profits they can. No government can fully protect a borrower. Anyone searching for an ethical car title loan company should know their rights, do their research, and read their contracts.

Some of the school’s most popular areas of study include creative writing, hospitality management, dental hygiene and accounting.
