Reconsiderations The attending physician/dentist or the hospital may request reconsideration of the adverse determination of the ACRC regarding the need for admission, readmission, transfer, or continued stay. This reconsideration right applies regardless of the current hospitalization status of the beneficiary. Reconsiderations must be requested within three business days of the adverse determination. (Refer to the Directory Appendix for ACRC contact information.) If requested by the ACRC, the provider must provide written documentation. The provider is notified of the reconsideration decision within one business day of receipt of the request or the date of receipt of written documentation. If the initial adverse determination is overturned, the adverse determination is considered null and void. If the initial adverse determination is upheld or is modified in such a manner that some portion of the hospital care is not authorized, the hospital is liable for the cost of care provided from the date of the initial determination, unless this determination is overturned in the Medicaid appeals

If the ACRC does not authorize the admission or the continued stay for an admission and the beneficiary remains in the hospital for one or more days after Medicaid payment is not authorized, the hospital is at risk of Medicaid nonpayment for those days. I used to know who I was, who you were, who we were. But right now I don’t. Right now I am looking for my edges and I can sometimes only find them when I am pulling on you. When I push everything I used to know to its edge. Then I feel like I exist and for a minute I can breathe. I know you long for the sweeter kid that I was. I know this because I long for that kid too, and some of that longing is what is so painful for me right now.

I need this fight and I need to see that no matter how bad or big my feelings are—they won’t destroy you or me. I need you to love me even at my worst, even when it looks like I don’t love you. Statute of Limitations

The period of time during which you can file a lawsuit varies depending on the type of legal claim. Here are the statutes of limitations for some common types of legal disputes:

  • Personal injury: Two years from the injury. If the injury was not discovered right away, then it is 1 year from the date the injury was discovered.
  • Breach of a written contract: Four years from the date the contract was broken.
  • Breach of an oral contract: Two years from the date the contract was broken.
  • Property damage: Three years from the date the damage occurred.
  • Claims against government agencies: You must file a claim with the agency within 6 months (for some cases, 1 year) of the incident. If the claim is denied, you can then file your lawsuit in court but there are strict limits to when, so read the section on government claims and the chart on statute of limitations below.

Some crimes, such as murder, are considered so terrible that they often have no statute of limitations period. See a table for “statutes of limitations” in many types of cases.

Government claims

When you sue a government agency, you first have to file a special claim (called an “administrative claim”) with the government office or agency before you file in court. You have to use the government’s form to file the claim.

  • For personal injury or personal property damage, you must file your administrative claim within 6 months of the date of the injury. (There are a few exceptions. Review California Government Code section 905 and section 911.2 or talk to a lawyer.)
  • For breach of contract and real property damage cases: You must file your administrative claim within 1 year of the date the contract was broken or the real property damage occurred.

After you file your claim, the government has 45 days to respond. If the government agency denies your claim during the 45 days, you have 6 months to file a lawsuit in court from date the denial was mailed or personally delivered to you. If you do not get a rejection letter, you have 2 years to file from the day the incident occurred. But do not count on having 2 years to file your claim.

Tolling of the statute of limitations

Sometimes the statute of limitations is suspended (“tolled”) for a period of time, and then begins to run again. For example, tolling may happen when the defendant is a minor, is out of the state or in prison, or is insane. When the reason for the tolling ends (like if the minor turns 18, or the defendant returns to California or gets out of prison, or the defendant is no longer insane), the statute of limitations begins to run again.

Cases dealing with tolling may be very complicated and you need to talk to a lawyer.

Most common statutes of limitations

This table lists the most common time periods for starting lawsuits also known as filing a claim. The law on time periods for starting lawsuits is found in California Code of Civil Procedure sections 312-366. Check these code sections to confirm how much time you have to file your lawsuit.

Check the Code of Civil Procedure sections if the problem is different from those listed here because the time period to sue may be anywhere from months to many years.

IMPORTANT: Make sure you read the law that applies to your specific case because there may be exceptions or other laws that apply to the facts in your case. Talk to a lawyer to make sure you understand the statute of limitations that applies to your specific case.

Time Period During Which You May Sue (or Be Sued)

Injury to a person. The defendant hurts you with or without intending to hurt you. For example, personal injury accidents, wrongful death, assault, battery, intentional or negligent infliction of emotional distress, wrongful act, or negligent act, etc. California Code of Civil Procedure section 335.1.

Damage to property. The defendant damages or destroys your property either with or without intending to damage it. For example, taking your personal property (conversion), crashing your vehicle, going onto your property without permission (trespass), fraud, nuisance, etc. California Code of Civil Procedure section 338. Libel or slander. The defendant defames you in print, writing, or pictures (libel) or verbally (slander). California Code of Civil Procedure section 340(c).

Oral contracts. Contracts that you and the defendant did not write down. California Code of Civil Procedure section 339. (Most oral contracts will have some sort of writing, e.g., a receipt, a canceled check, etc. This writing may be proof that you had an oral contract.)

Known (apparent) problems (called “patent defects”) in real property improvement design, survey, construction, etc., and resulting injury to property or person. California Code of Civil Procedure section 337.1. These usually are lawsuits against architects, contractors, or builders.

Against a health-care provider (medical malpractice). 1 year from the date plaintiff knows or should have known about the injury, or 3 years from the date of the injury whichever is the earlier date. California Code of Civil Procedure section 340.5.

Against a bank. If a bank paid on a check that was signed without authorization or where the signature was forged. California Code of Civil Procedure, Section 340.

Against government agencies or offices. These cases require that you file a special claim (called an “administrative claim”) with the government office or agency before you file in court. You have to use the government’s form to file the claim.

  • Personal property and personal injury/death cases: You must file your administrative claim within 6 months of the date of the injury. Government Code section 911.2
  • Breach of contract and real property damage cases: You must file your administrative claim within 1 year of the date the contract was broken or the real property damaged. See the reference to claims relating to “any other cause of action” under Government Code section 911.2.
  • After you file your claim, the government has 45 days to respond. Government Code section 912.4.
    • If the government agency

PRIOR AUTHORIZATION CERTIFICATION EVALUATION REVIEW (PACER)

Reconsiderations The attending physician/dentist or the hospital may request reconsideration of the adverse determination of the ACRC regarding the need for admission, readmission, transfer, or continued stay. This reconsideration right applies regardless of the current hospitalization status of the beneficiary. Reconsiderations must be requested within three business days of the adverse determination. (Refer to the Directory Appendix for ACRC contact information.) If requested by the ACRC, the provider must provide written documentation. The provider is notified of the reconsideration decision within one business day of receipt of the request or the date of receipt of written documentation. If the initial adverse determination is overturned, the adverse determination is considered null and void. If the initial adverse determination is upheld or is modified in such a manner that some portion of the hospital care is not authorized, the hospital is liable for the cost of care provided from the date of the initial determination, unless this determination is overturned in the Medicaid appeals

If the ACRC does not authorize the admission or the continued stay for an admission and the beneficiary remains in the hospital for one or more days after Medicaid payment is not authorized, the hospital is at risk of Medicaid nonpayment for those days. The provider may request post-discharge review by the ACRC, regardless of whether reconsideration was requested on the case, in writing within 30 calendar days of the discharge from the hospital. A copy of the medical record must accompany the post-discharge review request.

I used to know who I was, who you were, who we were. But right now I don’t. Right now I am looking for my edges and I can sometimes only find them when I am pulling on you. When I push everything I used to know to its edge. Then I feel like I exist and for a minute I can breathe. I know you long for the sweeter kid that I was. I know this because I long for that kid too, and some of that longing is what is so painful for me right now.

I need this fight and I need to see that no matter how bad or big my feelings are—they won’t destroy you or me. I need you to love me even at my worst, even when it looks like I don’t love you. I need you to love yourself and me for the both of us right now. I know it sucks to be disliked and labeled the bad guy. I feel the same way on the inside, but I need you to tolerate it and get other grownups to help you. Because I can’t right now. If you want to get all of your grown up friends together and have a ‘surviving-your-teenager-support-group-rage-fest’ that’s fine with me. Or talk about me behind my back I don’t care. Just don’t give up on me. Don’t give up on this fight. I need it.

This is the fight that will teach me that my shadow is not bigger than my light. This is the fight that will teach me that bad feelings don’t mean the end of a relationship. This is the fight that will teach me how to listen to myself, even when it might disappoint others.

And this particular fight will end. Like any storm, it will blow over. And I will forget and you will forget. And then it will come back. And I will need you to hang on to the rope again. I will need this over and over for years.

As you may be aware, the use of a cell phone while driving quadruples the risk of an accident, making it as dangerous as driving while drunk. (See the study by the University of Toronto in the February 13, 1997, New England Journal of Medicine.) This selfish and dangerous conduct by your insured led directly to this serious accident. [NOTE: Emphasizes how bad the other driver would look to a jury if the case ever went to court.]

I was badly battered by the collision and was taken by ambulance to the emergency room of Providence Hospital. Immediately after the accident, I had severe pain and stiffness in my back and a headache that was rapidly getting worse. After X-rays, I was released and advised to see my private physician. During the night, my headache became more severe and I was unable to move my back. First thing in the morning I was taken to my personal physician, Ann Lindley, M.D., who referred me to an orthopedist, Martin Chuzzlewit, M.D. Dr. Chuzzlewit examined me and discovered an inflammation of the lumbar spine. He prescribed pain and muscle relaxant medication, advised immediate bed rest, and referred me to physical therapy. [NOTE: It is important to point out that the orthopedist referred Mary to physical therapy, showing that she did not decide to go on her own. In the mind of an insurance adjuster, that makes the physical therapy treatments more medically legitimate.]

I was forced by the pain to remain in bed for the next four days. I attempted to return to work the following Monday, but the pain once again forced me to bed for another two days. [NOTE: Good to mention that Mary tried to return to work; it shows that she was not just using her injury as an excuse for a holiday.] I began physical therapy at the Bendright Clinic. I continued in physical therapy for five weeks, during which I remained in considerable pain and discomfort. After completing the physical therapy, I returned for an examination by Dr. Chuzzlewit, who advised me that I would have residual pain and stiffness for another few months. [NOTE: The doctor confirms long period of recovery.]

Because of the unlawful and dangerous driving [NOTE: reminding the insurance company that the insured’s driving would look very bad if the claim ever made it to court] of your insured, I suffered excruciating back pain requiring some five weeks of physical therapy. The pain has taken months to subside. I continue to suffer occasional pain and stiffness now, some six months after the accident. Also, the trauma of so narrowly missing a direct hit by your insured’s car has made me fearful of driving and causes me daily anxiety when I have to drive anywhere. Statute of Limitations

The period of time during which you can file a lawsuit varies depending on the type of legal claim. Here are the statutes of limitations for some common types of legal disputes:

  • Personal injury: Two years from the injury. If the injury was not discovered right away, then it is 1 year from the date the injury was discovered.
  • Breach of a written contract: Four years from the date the contract was broken.
  • Breach of an oral contract: Two years from the date the contract was broken.
  • Property damage: Three years from the date the damage occurred.
  • Claims against government agencies: You must file a claim with the agency within 6 months (for some cases, 1 year) of the incident. If the claim is denied, you can then file your lawsuit in court but there are strict limits to when, so read the section on government claims and the chart on statute of limitations below.

Government claims

When you sue a government agency, you first have to file a special claim (called an “administrative claim”) with the government office or agency before you file in court. You have to use the government’s form to file the claim.

  • For personal injury or personal property damage, you must file your administrative claim within 6 months of the date of the injury. (There are a few exceptions. Review California Government Code section 905 and section 911.2 or talk to a lawyer.)
  • For breach of contract and real property damage cases: You must file your administrative claim within 1 year of the date the contract was broken or the real property damage occurred.

After you file your claim, the government has 45 days to respond. If the government agency denies your claim during the 45 days, you have 6 months to file a lawsuit in court from date the denial was mailed or personally delivered to you. If you do not get a rejection letter, you have 2 years to file from the day the incident occurred. But do not count on having 2 years to file your claim.

Tolling of the statute of limitations

Sometimes the statute of limitations is suspended (“tolled”) for a period of time, and then begins to run again. For example, tolling may happen when the defendant is a minor, is out of the state or in prison, or is insane. When the reason for the tolling ends (like if the minor turns 18, or the defendant returns to California or gets out of prison, or the defendant is no longer insane), the statute of limitations begins to run again.

Cases dealing with tolling may be very complicated and you need to talk to a lawyer.

Most common statutes of limitations

This table lists the most common time periods for starting lawsuits also known as filing a claim. The law on time periods for starting lawsuits is found in California Code of Civil Procedure sections 312-366. Check these code sections to confirm how much time you have to file your lawsuit.

Check the Code of Civil Procedure sections if the problem is different from those listed here because the time period to sue may be anywhere from months to many years.

IMPORTANT: Make sure you read the law that applies to your specific case because there may be exceptions or other laws that apply to the facts in your case. Talk to a lawyer to make sure you understand the statute of limitations that applies to your specific case.

Time Period During Which You May Sue (or Be Sued)

Injury to a person. The defendant hurts you with or without intending to hurt you. For example, personal injury accidents, wrongful death, assault, battery, intentional or negligent infliction of emotional distress, wrongful act, or negligent act, etc. California Code of Civil Procedure section 335.1.

Damage to property. The defendant damages or destroys your property either with or without intending to damage it. For example, taking your personal property (conversion), crashing your vehicle, going onto your property without permission (trespass), fraud, nuisance, etc. California Code of Civil Procedure section 338. Libel or slander. The defendant defames you in print, writing, or pictures (libel) or verbally (slander). California Code of Civil Procedure section 340(c).

Oral contracts. Contracts that you and the defendant did not write down. California Code of Civil Procedure section 339. (Most oral contracts will have some sort of writing, e.g., a receipt, a canceled check, etc. This writing may be proof that you had an oral contract.)

Known (apparent) problems (called “patent defects”) in real property improvement design, survey, construction, etc., and resulting injury to property or person. California Code of Civil Procedure section 337.1. These usually are lawsuits against architects, contractors, or builders.

Against government agencies or offices. These cases require that you file a special claim (called an “administrative claim”) with the government office or agency before you file in court. You have to use the government’s form to file the claim.

  • Personal property and personal injury/death cases: You must file your administrative claim within 6 months of the date of the injury. Government Code section 911.2
  • Breach of contract and real property damage cases: You must file your administrative claim within 1 year of the date the contract was broken or the real property damaged. See the reference to claims relating to “any other cause of action” under Government Code section 911.2.
  • After you file your claim, the government has 45 days to respond. Government Code section 912.4.
    • If the government agency
      • Denies your claim during the 45 days, you have 6 months to file in court from date the denial was mailed or personally delivered to you. Government Code sections 912.4, 912.6.
      • Does not respond to your claim during the 45 days, you have 2 years from the date the incident occurred to file in court. Government Code section 945.6 (a)(2).

How to Write a Lost Wage Income Demand Letter

You need a lost wage and income demand letter to ask for monetary compensation for lost earnings related to injuries from an accident caused by another party. You typically send a lost wage and income letter to the insurance company of the other party. For example, you would send a demand letter to the auto insurance company providing coverage for a person who hit your car if the accident resulted in injuries to you and you missed time from work. A properly written demand letter improves your chances of getting back the earnings you lost.

Make a list of the lost income and wages to get an accurate total. For example, if you lost 20 hours of work, multiply the 20 hours by your hourly pay rate. Estimate as accurately as possible for self-employment wages. Compare the same 20-hour span from previous weeks to get an average income. Make copies of supporting documents, such as pay-stubs or business activity reports.

Ask the treating physician for a letter stating the dates you could not work. Ask the physician to include possible future dates of missed work.

Ask your employer for a lost wage and income statement if possible. Ask the employer to include how many hours lost and the total lost earnings.

Describe the accident in the first section of the letter. Include what you were doing at the time, the accident itself and that the other party is at fault. State any outside facts that point to the other party being at fault, such as witness statements and police reports.

Describe the medical treatments, pain you experienced and damage you suffered from the accident in the second section. Include medical terms. State the length of recovery and the injury s effects on everyday life.

List the lost wages and income in the third part of the letter. Include the future lost wages estimation. Mention the physician s letter. Refer to the employer letter if you have one. Show how you calculated the total if you do not have an employer letter and refer to the supporting documents.

State the monetary demand in the last section of the letter. Include the current and future lost wages, but round up to leave room for negotiation. Specify the demanded amount is only for lost income and wages.

Sign the letter. Print your name underneath the signature. Attach any supporting documents to the back of the letter.

About one-third of women experience hair loss (alopecia) at some time in their lives; among postmenopausal women, as many as two-thirds suffer hair thinning or bald spots. Hair loss often has a greater impact on women than on men, because it’s less socially acceptable for them. Alopecia can severely affect a woman’s emotional well-being and quality of life.

The main type of hair loss in both sexes — and the subject of this article — is androgenetic alopecia, or female (or male) pattern hair loss. In men, hair loss usually begins above the temples, and the receding hairline eventually forms a characteristic “M” shape; hair at the top of the head also thins, often progressing to baldness. In women, androgenetic alopecia begins with gradual thinning at the part line, followed by increasing diffuse hair loss radiating from the top of the head. A woman’s hairline rarely recedes, and women rarely become bald.

There are many potential causes of hair loss, including medical conditions, medications, and physical or emotional stress. If you notice unusual hair loss of any kind, it’s important to see your primary care provider or a dermatologist, to determine the cause and appropriate treatment. You may also want to ask your clinician for a referral to a therapist or support group to address emotional difficulties. Hair loss can be frustrating, but recent years have seen an increase in resources for coping with the problem.

Patterns of female hair loss

Clinicians use the Ludwig Classification to describe female pattern hair loss. Type I is minimal thinning that can be camouflaged with hair styling techniques. Type II is characterized by decreased volume and noticeable widening of the mid-line part. Type III describes diffuse thinning, with a see-through appearance on the top of the scalp.

What is androgenetic alopecia?

Almost every woman eventually develops some degree of female pattern hair loss. It can start any time after the onset of puberty, but women tend to first notice it around menopause, when hair loss typically increases. The risk rises with age, and it’s higher for women with a history of hair loss on either side of the family.

As the name suggests, androgenetic alopecia involves the action of the hormones called androgens, which are essential for normal male sexual development and have other important functions in both sexes, including sex drive and regulation of hair growth. The condition may be inherited and involve several different genes. It can also result from an underlying endocrine condition, such as overproduction of androgen or an androgen-secreting tumor on the ovary, pituitary, or adrenal gland. In either case, the alopecia is likely related to increased androgen activity. But unlike androgenetic alopecia in men, in women the precise role of androgens is harder to determine. On the chance that an androgen-secreting tumor is involved, it’s important to measure androgen levels in women with clear female pattern hair loss.

In either sex, hair loss from androgenetic alopecia occurs because of a genetically determined shortening of anagen, a hair’s growing phase, and a lengthening of the time between the shedding of a hair and the start of a new anagen phase. (See “Life cycle of a hair.”) That means it takes longer for hair to start growing back after it is shed in the course of the normal growth cycle. The hair follicle itself also changes, shrinking and producing a shorter, thinner hair shaft — a process called “follicular miniaturization.” As a result, thicker, pigmented, longer-lived “terminal” hairs are replaced by shorter, thinner, non-pigmented hairs called “vellus.”

Life cycle of a hair

Each hair develops from a follicle — a narrow pocket in the skin — and goes through three phases of growth. Anagen (A ), the active growth phase, lasts two to seven years. Catagen (), the transition phase, lasts about two weeks. During this phase, the hair shaft moves upward toward the skin’s surface, and the dermal papilla (the structure that nourishes cells that give rise to hair) begins to separate from the follicle. Telogen (C ), the resting phase, lasts around three months and culminates in the shedding of the hair shaft.

A clinician diagnoses female pattern hair loss by taking a medical history and examining the scalp. She or he will observe the pattern of hair loss, check for signs of inflammation or infection, and possibly order blood tests to investigate other possible causes of hair loss, including hyperthyroidism, hypothyroidism, and iron deficiency. Unless there are signs of excess androgen activity (such as menstrual irregularities, acne, and unwanted hair growth), a hormonal evaluation is usually unnecessary.

Treatment with medications

Medications are the most common treatment for female pattern hair loss. They include the following:

Minoxidil (Rogaine, generic versions). This drug was introduced as a treatment for high blood pressure, but people who took it noticed that they were growing hair in places where they had lost it. Research confirmed that a 2% solution of minoxidil applied directly to the scalp could stimulate hair growth. How it works is still not clear. Two double-blind studies of women ages 18 to 45 demonstrated its effectiveness. In one study, 13% of female minoxidil users had moderate hair growth, and 50%, minimal growth (compared with 6% and 33%, respectively, in the placebo group). In the second study, 60% of women in the minoxidil group reported new hair growth, compared with 40% in the placebo group. As a result of these studies and others, over-the-counter 2% minoxidil is FDA-approved for treating androgenetic alopecia in women.

Clearly, minoxidil is not a miracle drug. While it can produce some new growth of fine hair in some — not all — women, it can’t restore the full density of the lost hair. It’s not a quick fix, either. You won’t see results until you use the drug for two months. The effect often peaks at around four months, but it could take longer, so plan on a trial of six to 12 months. If minoxidil works for you, you’ll need to keep using it to maintain those results. If you stop, you’ll start to lose hair again.

How to use minoxidil: Be sure that your hair and scalp are dry. Using the dropper or spray pump that’s provided with the over-the-counter solution, apply it twice daily to every area where your hair is thinning. Gently massage it into the scalp with your fingers so it can reach the hair follicles. Then air-dry your hair, wash your hands thoroughly, and wash off any solution that has dripped onto your forehead or face. Don’t shampoo for at least four hours afterwards.

Some women find that the minoxidil solution leaves a deposit that dries and irritates their scalp. This irritation, called contact dermatitis, is probably caused not by the minoxidil itself, but rather by the alcohol that is included to facilitate drying. A 5% solution (available only by prescription and approved only for men) is more effective than the 2% formulation and may be prescribed off-label for women. The 5% version comes in a foam, which appears to cause less irritation than the liquid.

Side effects and concerns: Minoxidil is safe, but it can have unpleasant side effects even apart from the alcohol-related skin irritation. Sometimes the new hair differs in color and texture from surrounding hair. Another risk is hypertrichosis — excessive hair growth in the wrong places, such as the cheeks or forehead. (This problem is more likely with the stronger 5% solution.) Because the patent on Rogaine (the brand-name version of minoxidil) has expired, many generic products are available. They all contain the same amount of minoxidil, but some include additional ingredients, such as herbal extracts, which might trigger allergic reactions.

Anti-androgens. Androgen receptor–blocking drugs such as spironolactone (Aldactone) and finasteride (Propecia) are not approved for the treatment of female pattern hair loss, and there is little reliable evidence that they are effective. However, some case studies suggest that women who don’t respond to minoxidil may benefit from the addition of spironolactone. In the relatively uncommon cases where there is an excess of androgen, a clinician may prescribe 100 to 200 milligrams of an androgen receptor–blocking drug daily, together with an oral contraceptive for women of reproductive age. (A woman taking one of these drugs should not become pregnant because they can cause genital abnormalities in a male fetus.) Possible side effects include weight gain, loss of libido, depression, and fatigue.

Iron supplements. In some women, iron deficiency could be a cause of hair loss. Your clinician may test your iron level, particularly if you’re a vegetarian, have a history of anemia, or have heavy menstrual bleeding. Iron supplements are recommended if a woman’s iron level is less than 70 nanograms per milliliter. However, there’s no reliable evidence that iron supplementation is helpful for female pattern hair loss.

This case involves a rear-end motor vehicle accident with clear liability. Your company has already paid $1,978.16, representing 100% of Mr. Head s property damage.

My client was severely injured on May 19, 2005, as a result of this accident. Joseph Anderson, MD., of Suburban Primary Care, first examined him on June 5, 2005. Dr. Anderson diagnosed Mr. Head as having suffered a left paravertebral muscle strain and a probable leg strain.

On June 17, 2012, Mr. Head came under the care of Dr. David Smith. Mr. Head remained under Dr. Smith s care through April 6, 2012. He was treated consistently throughout this period of time.

At the time of Dr. Smith s initial examination, Mr. Head complained of headaches, neck pain, thoracic spine pain, left arm, leg, and hip pain. He had difficulty sitting, standing, and performing activities of daily living and work duties.

Because of the lingering nature of these injuries, Dr. Smith scheduled Mr. Head for an MRI and an EMG. The MRI was conducted on September 17, 2012, and was positive for bulging disc at L4-L5 and L5-S1 and spondylosis. The EMG was conducted on October 4, 2004. It was normal.

As of November 29, 2012, Mr. Head still had post-traumatic headaches and severe pain to his left cervical spine, low back, and left leg. He continued to make slight improvement with treatment through January 18, 2005, although his prognosis had not improved. In Dr. Smith s report of February 9, 2012, he notes that Mr. Head was progressing with treatment, but that he continued to complain of stiffness in the lower back and neck pain. In Dr. Smith s discharge report of April 6, 2005, he notes that Mr. Head still complained of lower back stiffness and right arm pain.

It was Dr. Smith s clinical opinion that, as of April 6, 2005, my client s condition had become permanent, and that further treatment would not necessarily elicit further improvement. He was discharged with a poor prognosis and was told that he would simply have to learn to live with his discomforts. It was Dr. Smith s clinical opinion within a reasonable degree of chiropractic/medical certainty that Mr. Head s injuries were a direct result of the accident of May 19, 2012, and that they are permanent.

In view of the clear liability and the severity of the damages sustained, settlement demand is hereby made in the amount of $65,000.00.
