Illegal Debt Collection Practices

The federal Fair Debt Collection Practices Act (FDCPA) makes illegal certain collection tactics used by collection agencies. Below we outline some of the more important of these restrictions so you know what bill collectors can and cannot do.

Facing Debt Collection? Know Your Rights Under the FDCPA

If you are dealing with a collector, or have a debt that may soon go to collection, it’s important to know what debt collection agencies can and cannot do. Not only can you use your knowledge of these laws to protect yourself from harassment, but if a collector violates one of these laws, you may be able to: use the violation to negotiate a better settlement, file a complaint with the Consumer Financial Protectin Bureau (CFPB) (for debt collectors with more than $10 million in annual receipts — about 60% of the debt collection business) or the Federal Trade Commission (FTC), or sue the collector.

FDCPA Applies to Debt Collectors, Not Creditors

The FDCPA applies to debt collectors only, not to creditors collecting their debts. However, some states have laws that restrict what creditors can do when collecting debts.

Illegal Debt Collection Practices Under the FDCPA

The FDCPA (15 U.S.C. 1692 to 1692p) requires that a collection agency make certain disclosures and prohibits the collector from engaging in many kinds of abusive or deceptive behavior. Here are some collection actions prohibited by the FDCPA.

Communications With Third Parties

For the most part, a collection agency cannot contact third parties about your debt. There are a few exceptions to this general rule. Collectors are allowed to contact:

  • Your attorney. If the collector knows you are represented by an attorney, it must talk only to the attorney, not you, unless you give it permission to contact you or your attorney doesn t respond to the agency s communications.
  • A credit reporting agency.
  • The original creditor.

Collectors are also allowed to contact your spouse, your parents (only if you are a minor), and your codebtors. But they cannot make these contacts if you have sent a letter asking them to stop contacting you.

There is one other exception. Debt collectors are allowed to contact third parties for the limited purpose of finding information about your whereabouts. In these contacts, collectors:

  • must state their name and that they are confirming location information about you
  • cannot identify their employer unless asked
  • cannot state that you owe a debt
  • cannot contact a third party more than once unless required to do so by the third party, or unless they believe the third party s earlier response was wrong or incomplete and that the third party has correct or complete information
  • cannot communicate by postcard
  • cannot use any words or symbols on the outside of an envelope that indicate they are trying to collect a debt (including a business logo or letterhead) if either would give away the purpose of the letter, and
  • cannot call third parties for location information once they know an attorney represents you.

Communications With You

A debt collector s first communication with you must tell you that he or she is attempting to collect a debt and that any information obtained from you will be used for that purpose. In subsequent communications, the collector must tell you his or her and the collection agency s name.

A collector cannot contact you:

  • at an unusual or inconvenient time or place calls before 8 a.m. and after 9 p.m. are presumed to be inconvenient (but, if you work nights and sleep during the day, a call at 1 p.m. may also be inconvenient)
  • directly, if it knows or should have known that you have an attorney, or
  • at work if it knows that your employer prohibits you from receiving collections calls at work. (If you are contacted at work and you are not allowed to have personal calls at work, tell the collector that your boss prohibits such calls.)

Harassment or Abuse

In general, a collection agency cannot engage in conduct meant to harass, oppress, or abuse. Specifically, it cannot:

  • use or threaten to use violence
  • harm or threaten to harm you, another person, or your or another person s reputation or property
  • use obscene, profane, or abusive language
  • publish your name as a person who doesn t pay bills (child support collection agencies are exempt from this in some states)
  • list your debt for sale to the public
  • call you repeatedly, or
  • place telephone calls to you without identifying the caller as a bill collector.

You never have to put up with harassment. Just hang up the phone, or put the receiver down (without hanging up) and walk away.

False or Misleading Representations

A collection agency can t lie. For example, it can t:

  • claim to be a law enforcement agency or suggest that it is connected with the federal, state, or local government (a collector making this kind of claim is probably lying, unless it s trying to collect unpaid child support, or it s a private check diversion program under contract with a district attorney)
  • falsely represent the amount you owe or the amount of compensation the collection agency will receive
  • claim to be an attorney or that a communication is from an attorney
  • claim that you ll be imprisoned or your property will be seized, unless the collection agency or original creditor intends to take action that could result in your going to jail or your property being taken (you can go to jail only for extremely limited reasons see Can I Go to Jail if I Don’t Pay My Debts? )
  • threaten to take action that isn t intended or can t be taken for example, if a letter from a collection agency states that it is a final notice, it cannot write you again demanding payment
  • falsely claim you ve committed a crime
  • threaten to sell a debt to a third party, and claim that, as a result, you will lose defenses to payment you had against the creditor (such as a breach of warranty)
  • communicate false credit information, such as failing to state that you dispute a debt
  • send you a document that looks like it s from a court or attorney or part of a legal process if it is not
  • use a false business name, or
  • claim to be employed by a credit bureau, unless the collection agency and the credit bureau are the same company.

Unfair Practices

A collection agency cannot engage in any unfair or outrageous method to collect a debt. For example, it can t:

  • add interest, fees, or charges not authorized in the original agreement or by state law
  • accept a check postdated by more than five days unless it notifies you between three and ten days in advance of when it will deposit the check
  • deposit a postdated check prior to the date on the check
  • solicit a postdated check for the purpose of then threatening you with criminal prosecution
  • cause you to incur communications charges, such as collect call fees, by concealing the true purpose of the communication
  • threaten to seize or repossess your property if it has no right to do so or no intention of doing so
  • communicate with you by postcard, or
  • put any words or symbols on the outside of an envelope sent to you that indicate it s trying to collect a debt.

How to Apply for a Minority Business Grant

Minority-owned business grants are meant to help small businesses that are owned by members of minority populations who are considered to be socially or economically disadvantaged. These grants can be used to expand businesses or help a business develop new technologies or training practices. In order to qualify for a minority-owned business grant, your business must be at least 51% owned and operated by individuals from a minority population and must meet any specific eligibility criteria set forth by a grant.

Steps Edit

Part One of Three:
Becoming Certified as a Minority-Owned Business Edit

Meet the criteria for Minority Business Enterprise Certification (MBE). In order to qualify for many minority-owned business grants, you must first demonstrate that you meet the criteria for and MBE. One way to ensure that you qualify is to be certified as an MBE by the National Minority Supplier Development Council (NMSDC). [1] Certification significantly helps MBEs gain access to government contracts and grants. [2] In order to be certified, you must meet the following criteria:

  • You must be a U.S. citizen.
  • Your business must be at least 51% minority-owned operated and controlled. The NMSDC considers a person to be a member of a minority group if they are at least 25% Asian, Black, Hispanic or Native American. For publicly owned companies, at least 51% of the stock must be owned by one of more minority group members.
  • Your business must be for profit and located in the U.S. or one of its territories.
  • The management and daily operations of your business must run by the minority ownership member. [3]

Collect business documents. Depending on the type of business entity, you may need to provide business documentation including, but not limited to:

  • Partnership agreements.
  • Cancelled checks from the business.
  • Business Meeting Minutes.
  • Articles of Incorporation.
  • Bylaws.
  • Corporate Banking Agreements.
  • Business lease information.
  • Proof of citizenship.

Complete an online application. In order to become certified as an MBE by NMSDC, you must complete an online application located at http://www.nmsdc.org/mbes/mbe-certification/ The certification application may require the following information:

  • Name and contact information for the business.
  • Description of business’ products and/or services.
  • List of owners and shareholders.
  • Description of the type of business and business history.
  • Information about employees, including the number of minority employees.
  • Business owner information, including race/ethnic origin, gender, citizenship, and their role in the business.
  • Financial information about the business.

Pay your certification fee. In order to become a certified or recertified MBE, you must pay a certification fee that is linked to the region in which you live. Clinton Holds 11-Point National Lead Over Trump: NBC/WSJ Poll

Clinton leads Trump by 11-points in NBC/WSJ poll Monday, 17 Oct 2016 | 9:26 AM ET | 00:42

Hillary Clinton is ahead of Donald Trump by double digits with just over three weeks until Election Day, according to a new national NBC News/Wall Street Journal poll conducted entirely after the second presidential debate.

In a four-way race, Democrat Clinton holds an 11-point lead over Republican Trump among likely voters, 48 percent to 37 percent, with Libertarian Gary Johnson at 7 percent and the Green Party’s Jill Stein at 2 percent.

In a two-way contest without Johnson and Stein, Clinton is ahead by 10 points, 51 percent to 41 percent.

An earlier NBC/WSJ poll — conducted two days after 2005 video surfaced of Trump making vulgar comments to describe kissing and groping women — found Clinton leading by double digits among likely voters. But after another day of polling taken immediately after the Oct. 9 debate, the entire Oct. 8-10 poll showed Clinton’s lead at nine points in the four-way contest (46 percent to 37 percent) and 10 points in a head-to-head race (50 percent to 40 percent).

To put Clinton’s current 11-point lead into perspective, Barack Obama beat John McCain by seven points nationally in 2008. And Obama’s margin of victory over Mitt Romney in 2012 was four points.

“Donald Trump’s chances of winning this election have faded,” says Democratic pollster Fred Yang of Hart Research Associates, which conducted this survey with Republican pollster Bill McInturff and his firm Public Opinion Strategies.

“This poll is showing the writing on the wall,” Yang adds.

And the Republican McInturff observes that Trump “is in a weaker position than in September,” and that his numbers in the poll don’t align with anyone who has gone on to win a presidential election.

Clinton Up By 20 Points Among Women

Looking inside the numbers of the two-way horse race, Clinton holds a 20-point lead among female voters (55 percent to 35 percent), while Trump is ahead among men by just three points (48 percent to 45 percent).

Clinton also has the advantage among African Americans (86 percent to 9 percent), non-white voters (76 percent to 16 percent) and those ages 18-34 (54 percent to 36 percent).

Trump, meanwhile, holds the edge among independents (41 percent to 36 percent) and white voters (51 percent to 40 percent). But there is a difference among whites: Those without college degrees prefer Trump by a 56 percent-to-36 percent margin, while those with college degrees break evenly between Trump and Clinton, 45 percent to 45 percent.

As for the 2005 video of Trump talking about women in vulgar and crude terms, 95 percent of voters say they saw, read or heard about that news story – which is the fourth-most recognized story in the history of the NBC/WSJ poll (behind the Orlando terrorist attack, the spread of Ebola in West Africa and the Ebola patient in Dallas).

But just 32 percent say that the video disqualifies Trump from being president and believe that he should with withdraw from the race, versus 53 percent who disagree.

Did the debates make a difference?

Additionally in the NBC/WSJ poll, 31 percent of voters said the presidential debates made them more likely to back Hillary Clinton, versus 14 percent who said they made them more likely to support Trump.

Fifty-two percent said the debates made no difference.

The final presidential debate takes place on Wednesday, Oct. 19.

Trump leads (narrowly) on trade, economy; Clinton ahead on being a commander-in-chief and women’s issues

On the issues, more voters say Trump would do a better job protecting America’s interests on trade issues (by 46 percent to 43 percent). And he holds a one-point advantage on dealing with the economy (44 percent say Trump would do a better job, compared with 43 percent who say Clinton would).

But Clinton has the advantage on the other issues – making appointments to the Supreme Court (48 percent to 38 percent), changing the country for the better (44 percent to 36 percent), being a good commander-in-chief (52 percent to 32 percent) and dealing with issues of concern to women (67 percent to 17 percent).

When it comes to personal characteristics, Clinton leads on having the right temperament to be president (59 percent to 23 percent), while Trump narrowly leads on being honest and straightforward (38 percent to 34 percent).

Democrats don’t look as strong down the ballot

Despite Clinton’s double-digit lead over Trump in the presidential race, the NBC/WSJ poll finds a closer contest down the ballot. Forty-six percent of registered voters prefer a Democratic-controlled Congress, while 44 percent want a Republican-controlled Congress.

That two-point advantage for Democrats is down from six points in the earlier NBC/WSJ poll (48 percent to 42 percent).

Among likely voters in new poll, 47 percent want a Democratic-controlled Congress and 44 percent want a GOP-controlled one.

By a 53 percent-to-40 percent margin, the poll also finds registered voters saying they’d be more likely to support a Republican candidate who will be a check and balance to Hillary Clinton and congressional Democrats, versus a Democratic candidate who will help Clinton and Democrats pass their agenda.

53 percent approve of Obama’s job as president

Finally, the NBC/WSJ poll finds President Obama’s job-approval rating at 53 percent among registered voters, which is up one point from last month.

It’s the six-straight month where the president’s rating has been above 50 percent in the poll, and it’s his highest rating since Dec. 2012, after he won re-election four years ago.

The NBC/WSJ poll was conducted Oct. 10-13 of 1,000 registered voters – via both cell phones and landline phones – and it has an overall margin of error of plus-minus 3.1 percentage points. Among the poll’s 905 likely voters, the margin of error is plus-minus 3.3 percentage points.

Admission Requirements

Admission to the doctoral program occurs prior to initiation of course work. The number of students admitted will be limited to ensure quality of program and dissertation advising.

Applicants who are successful in their application for admission for entrance into the doctoral program will meet the following criteria:

  • Master’s degree with a minimum 3.0 GPA
  • A completed Doctoral Application for Admission
  • Submission of rationale statement, including personal goals for applying for admission to the program.
  • Transcripts: Submission of official transcripts of all previous credits.
  • Testing: Current Graduate Record Exam or Miller Analogies Test scores (test taken within the prior three years).
  • Letters of recommendation from two persons qualified to comment upon the applicant’s potential for doctoral study.
  • Past experience: At least two years of successful teaching/administrative experience (required only for doctoral programs in K-12 education).
  • Writing sample: Submit a paper that demonstrates your ability to write in a scholarly manner at a level typical of graduate work. A paper from your master’s program would be most appropriate. This sample should approach, but not exceed, five pages in length.

Once the admission file is completed and initially reviewed, qualified applicants will complete an extemporaneous writing sample followed by a personal interview with an admission committee.

Admission recommendations are submitted from the admission committee to the Dean of the College of Education, who will then make the final admission decision and communicate the decision to the candidate. The admission committee may establish an admission waiting list, if necessary. Students admitted should consult the Doctoral Program Handbook for additional program information.

Students who are applying for admission to the doctoral program are precluded from enrolling in any courses which met doctoral program requirements until the student has been completely admitted to the program.

The Graduate Admission Committee reserves the right to request additional information or documentation deemed helpful in evaluating applicants for admission.

Additional Testing

Depending on program of study, students may be required to take additional tests such as the Graduate Record Exam, Miller Analogies Test and/or the Illinois Basic Skills Test. A writing sample, essay, FBI fingerprint criminal background check, valid teaching certificate and/or interview may also be required to determine what may be necessary for a student to qualify for a graduate program.

Pending Status

Doctoral and international students are not eligible for Pending Status .

International Students

Applicants who are not U.S. citizens are required to meet all admission standards listed for the program they wish to enter. In addition, the following are required to be considered for admission:

  • TOEFL: A score of at least 550 (paper-based) or 72 (internet) minimum requirement on the Test of English as a Foreign Language (TOEFL), or successful completion of Level 112 at an English Language School (ELS) unless English is the native language, and an unqualified recommendation from an ELS program director is provided. (International students who have earned an advanced degree from an accredited institution in the United States do not need to submit TOEFL scores.)
  • Transcripts: Official transcripts from each college/university attended showing all college/university course work with certified English translations of all transcripts originally prepared in any other language. Also, any international transcripts must be evaluated by a Concordia-approved international credentialing service such as WES (World Education Services), ECE (Educational Credential Evaluators), or AACRAO (American Association of Collegiate Registrars and Admission Officers).
  • Financial Support: A certified document guaranteeing adequate financial support for at least the student’s first year of study and, barring any unforeseen circumstances, adequate funding from the same or an equally dependable source, for subsequent years.
  • Medical: A physical exam, adequate medical insurance, and proof of immunization are required prior to enrollment.
  • Regular Admission Requirements: International students must qualify for regular admission to a degree program in order to enroll.

All documents must be received by the Office of Graduate Admission and Enrollment Services at least three months prior to the expected date of entry. I-20 forms may be issued only after University acceptance is granted and will remain in effect only for students who continue to make satisfactory progress as full-time students in an accepted university program. The program length may vary for each student.

Voipfone – What Is VoIP?

VoIP stands for Voice over Internet Protocol. Sometimes it’s referred to as Voice over Networks or (VoN), Voice over Broadband (VoB) and sometimes Internet Telephony. VoIP allows you to make free, or very low cost, telephone calls over the Internet. You can call any telephone in the world and any telephone can call you – regardless of what equipment or network the person you are calling uses.

Also, because VoIP uses, digital, internet technologies (sip) many new features and services that were previously impossible, or very expensive using traditional telephone technology, become available. But you don’t need to know anything about the technologies used if you don’t want to, after all, you probably don’t know that ordinary telephony uses TDM (Time Division Multiplexing) but your telephone still works.

How Does It work?

Your voice is converted into digital information which can be sent like any other data over the internet. People are often confused by this but the way to think about it is that your internet connection uses the same wires as your normal landline telephone and can be uses to transmit all kinds of things such as faxes, telephone calls, emails, instant messages, web pages and Google searches – what makes the difference is simply what is plugged into the wires.

Before we get too far into the technology, we need to squash a myth. People tend to think that VoIP is about cheap calls – and it’s true that VoIP calls are cheap – but the real benefit of VoIP is that calls can be totally free and that all sorts of new services become possible with them.

Calls can be free not because we’re a charity but because you’ve already paid for them in your monthly broadband subscription. When you make a call over the internet your voice is converted to data and sent like any other piece of data down your internet connection; just like web surfing and email; you don’t have to pay again to use it. So, if you call another Voipfone user anywhere in the world, it’s a free call – you only pay if you call an old fashioned telephone network.

This Is All Very Complicated Isn’t It?

How Can I Make a VoIP Call?

Normally you just to pick up your phone and dial the number! The most primitive form of VoIP uses your PC as a telephone and we provide you with a software telephone – a softphone – to do this. This displays a model of a telephone on your screen and you simply type the number to be dialled in or click on the phone’s directory to dial the number.

You can either use your PCs speakers and microphone of use a simple headset to talk.

For business use though, most people use purpose built VoIP telephones or telephone adapters with ordinary telephones plugged in. Apart from the obvious benefits of convenience to use and quality of call this method means that your telephones work even when your PC is switched off.

What Kind Of Equipment Do I Need?

A broadband (high speed Internet) connection is required for most, but not all, of our services. This can be through a cable modem such as NTL/Virgin, or services such as ADSL.

To make phone calls you then either use a softphone on your PC or laptop (see above) or a purpose built VoIP telephone or telephone adapter.

If I Use A VoIP Service Who Can I Call?

You can call anyone, anywhere on any type of telephone or network. The receiver of the call needs to have no special equipment and won’t know what kind of call he is receiving. However, if the person receiving your call is another Voipfone customer the call will be free – no matter where he is located in the world.

Does It Sound As Good As An Ordinary Telephone Call?

Normally the call will sound identical to an ordinary telephone call – you won’t be able to tell the difference. If your call is to another Voipfone customer and you are both using Voipfone and VoIP telephones the call quality is much better than an ordinary call – this is because it is transmitted digitally end to end at 64kbs – ie radio quality sound.

Can I Use My Computer While I talk On The Phone?

Can I Take My telephone Or Phone Adapter With Me When I Travel?

You can use your VoIP telephone service wherever you travel as long as you have access to a high speed Internet connection. In that case it would work exactly the same as from your home or business.

Does My Computer Have To Be Turned on?

Not if you are making calls with a VoIP telephone or a VoIP telephone adaptor, but your broadband Internet connection needs to be active. You can also use your computer while talking on the phone.

How Do I Know If I Have A VoIP Phone Call?

It will ring like any other call.
