Can I Claim Benefit?

You can make a claim for Housing Benefit and Council Tax Reduction if:

  • You pay rent to a private landlord, housing association, or a council property. But you cannot claim Housing Benefit if you rent from close relatives or the landlord also lives in the same property. A close relative is a parent/step parent or sibling/step sibling. However, if the relative has a commercial tenancy agreement (ie they are a landlord who has let properties previously) then you may be able to claim
  • You have to pay Council Tax on your home. But if you live in a property that is band E or higher you will only be paid up to the amount for a band D property
  • Your savings are less than 16,000 for Housing Benefit and 6000 for Council Tax Reduction applications
  • You work full time or part time (employed or self-employed) and get a low wage
  • You get Benefit or Tax Credit managed by the Department for Work and Pensions, the Inland Revenue or any other low income.

The rules on claiming Housing Benefit and Council Tax Reduction for self-employed people, students, people from abroad and people who have savings are different to those who get Benefit or Pensions.

How Much Benefit Could I Get?

This is based on the amount of income and savings you have. The more you have the less you get. When we work out your Benefit we take into account:

  • How much money you have coming in each week

Working age – there will be a cap on the amount of benefits that you can get. The Benefit Cap forms part of the Welfare Reform Changes that came into force from April 2013. There are a number of benefits that are included in the Benefit Cap as well as a number of benefits and circumstances that will exclude you from having the cap applied. The Benefit Cap factsheet in Related downloads can explain this further.

If you are not excluded from the benefit amount cap, it will be set at:

  • 500 per week for couples and lone parents; or
  • 350 per week for single adults.
  • How much you have in savings and investments
  • Who lives in your household and their circumstances
  • How much rent and Council Tax you have to pay
  • Whether you are of pension age or working age
  • How many rooms you need for your household (Housing Benefit only).

Renting from South Essex Homes or Housing Associations

Working age – the amount that you are awarded for Housing Benefit depends on the number of rooms you are allowed for your family circumstances, this is known as Size Criteria . Size Criteria forms part of the Welfare Reform Changes that came into force from April 2013. If you are considered to have:

  • 1 extra bedroom you will have a 14% reduction on your Housing Benefit
  • 2 or more extra bedrooms you will have a 25% reduction to your Housing Benefit

You will have to make up the difference yourself. There are some groups of people that are excluded from having the size criteria applied to their claim. For further information about these groups of people please see the Size Criteria Factsheet 2014 in Related Downloads.

Renting from a Private Landlord

If you are working age or pension age the amount you get depends on the Local Housing Allowance rate for the size property you are claiming for. The rates and are updated yearly and can be found in the LHA Rates 2017/2018 Poster in Related Downloads.

Payment on Two Homes

Housing Benefit is normally only paid for one home at a time. However, there are some exceptions where the council may consider paying benefit on two homes. These exceptions are:

  • You have moved into rented accommodation due to fear of violence
  • You are a student/trainee, one of a couple and have to live in separate rented accommodation
  • You have a large family and the council has housed you in two properties
  • You have moved to a new home which you have to pay rent for, but still have to pay rent for a period of time on the old property. This is known as unavoidable overlapping liability.

    Benefits Extension

    Unemployment nj claim benefitsIf you are speculating what happens once your normal unemployment benefits expire in New Jersey, the answer is extended unemployment benefits. Extended unemployment benefits let you to continue receiving your benefits while you search for a new job. Fundamental qualifications for extended benefits are the same as for regular benefits. However, your normal benefits must run out by a certain date for in order for the extended benefits to commence. That is why the application is automatic in New Jersey.

    Since May2006, the State of New Jersey provides federally funded emergency unemployment compensation. This compensation is obtainable to those who have worn out the standard benefits. Standard New Jersey jobless benefits are good for 13 weeks. The emergency unemployment compensation can lengthen these benefits for an additional 7 weeks for those who qualify. Not everyone will meet eligibility requirements.

    Extension Requirements

    In order to be eligible for New Jersey extended benefits, you must have either worked no less than 20 weeks during your base period at a minimum weekly wage of $145, as of 2011, or earned 40 times your weekly benefit amount all through your base period.

    When you enter the New Jersey extension portion of your unemployment benefits, the set of laws about continued eligibility become stricter than during your standard benefits period. You must submit evidence of your work search each week that you file for benefits, and the state becomes more cautious about keeping tabs on your work search.

    Time Frame

    Unemployment nj claim benefitsThe maximum length of time for collecting unemployment benefits in New Jersey differs according to several factors. You can potentially collect extended benefits for 13 or 20 weeks based on the unemployment rate at that time. When the jobless rate in New Jersey is at least 6.5%, you can obtain benefits for an additional 13 weeks after your regular benefits run out. If the jobless rate is 8% or greater, the extended benefits last for 20 weeks.

    With federal benefits in place, the order in which you obtain your benefits is:

    1. Regular state benefits,
    2. All available tiers of Emergency Unemployment Compensation, then
    3. Extended Benefits.

    Regular Benefits

    In times of fairly low unemployment, you can obtain unemployment benefits in New Jersey for up to 26 weeks. Your benefits might last for less than that based on how much time you spent working during your base period, which is the 1st four of the five most currently completed calendar quarters. For every week you worked up to 26 weeks, you can collect a week of unemployment benefits at a rate determined by your earnings.

    Emergency Unemployment Compensation (EUC)

    Unemployment nj claim benefitsUPDATE: Emergency unemployment compensation(E.U.C), a federally sponsored scheme for additional weekly benefits(after regular UI is exhausted) expired as on 28th Dec 2013. EUC is currently not available in any state.

    Through 2011, the federal government funded extensions that permit New Jersey residents to obtain unemployment for up to 99 weeks including regular benefits and Extended Benefits, which is now expired.

    Your entire benefits in each tier are a percentage of your whole regular benefits; hence if your normal benefits lasted less than 26 weeks, each tier of federal benefits would last for below the maximum duration.

    Extended Benefits (EB)

    Once the emergency unemployment compensation (EUC) runs out, extended benefits kick in. New Jersey offers 20 weeks of extended benefits beyond that point. In order for EB to become active, New Jersey had to have an unemployment rate that averaged 6.0% over a three-month period.

    How to File for New Jersey Extended Unemployment Benefits

    1. Unemployment nj claim benefitsDecide your eligibility for New Jersey Unemployment benefits. In order to qualify, you must be unemployed, not qualified for a new claim and have worked for no less than 20 consecutive weeks before termination and obtained at least $7500 in compensation from your employee.
    2. File an initial unemployment claim in the State of New Jersey. File online or in telephone at the State of New Jersey Department of Labor and Workforce Development. You will need to give personal information besides information on your previous employment.
    3. Look for employment while obtaining benefits. In case you make no such effort, your benefits will discontinue. The State of New Jersey requires proof that you are actively seeking a job while collecting unemployment.
    4. Get in touch with the State of New Jersey Department of Labor and Workforce Department to notify them that you have been incapable of gaining employment during the 13-week term of unemployment. The department automatically files the emergency extension of your jobless benefits for an additional 7 weeks.
    5. Keep on seeking employment as you progress through the tiers of emergency unemployment benefits. You do not need to apply as the New Jersey Department Labor and Workforce Development will continue to file the application on your behalf for each tier.

    Get extended benefits once you have worn out your fourth tier emergency unemployment benefits. Similar to the emergency unemployment benefits, the state files for you automatically. As of 2011, there is no running out of extended benefits only if the recipient keenly seeks employment.

    How to File Unemployment Benefits

    When you apply, you will need to have the following information available:

    • Your Social Security Number or Alien Registration Number;
    • The business name, address and telephone number of each place you worked at during the past 18 months; and
    • The jobs you held and the dates you worked (for each employer).

    Veterans who separated from the armed forces in the past 18 months will need to provide information from your DD-214. Federal civilian employees will need to provide information from your SF-8 or SF-50.

    Once you have filed your claim, you will receive the Benefits Rights Booklet and weekly claim forms in the mail.

    Filing Online

    You can file online from any computer connected to the internet. If you don’t have a computer at home, you can use computers at the CareerCenter or at many local libraries.

    The website portal allows individuals to create an online unemployment account; manage their profile, including editing contact information, username, password, PIN number and security reset questions/answers; and access a forgotten PIN, username, or password using security questions/answers. Current unemployment claimants can view and print heir benefit history transcripts, view their claim status, manage the direct deposit of their benefit payment, reopen an existing account or file a weekly unemployment claim. New users can access the Maine Job Bank, mainecareercenter.com and file an initial unemployment claim. Users can obtain benefit history transcript, often needed when applying for services from other agencies, for example, LiHeap.

    Frequently Asked Questions for Claimants

    Filing by Phone

    Call the Unemployment Claims Center toll-free at: 1-800-593-7660 or TTY: Maine relay 711. If you need interpreter services, press the number 1 once you are connected to the Claims Center and tell the Claims Representative what language you speak.

    Claims Center Wait Times: During periods of high call volumes, you may have a long wait time on the phone or get a message to call back later in the day. We apologize for the inconvenience. Wait times are typically shorter on Wednesdays and Thursdays and in the afternoon.

    If you do not have a phone at home, you can call from your nearest CareerCenter.

    Filing by Mail:

    To establish a new claim for unemployment (Initial claim) the quickest and most complete method is to file on the internet at www.file4ui.com. You will need to create your own web portal account and complete the initial claim process. The web portal provides a number of self-service options for you to manage your account.

    After you have established a new claim you must file weekly claims for unemployment for each week that you wish to file for benefits. You can file weekly claims on the internet through your web portal account. You may also file weekly claims on the telephone by calling 1-800-593-7660 and selecting the option to file weekly claims.

    Under certain conditions, you may be required to complete a weekly paper claim. Paper claims are required for Dislocated Worker Benefits, WorkShare, Trade, Extended Benefits and when your employer provides you with a partial unemployment form (B-9) to complete and submit to the claims center.

    Paper claims can be mailed or faxed to one of the claim centers posted on the back page of the blue booklet that is mailed to you when you establish a new claim for benefits.

    lwd.dol.state.nj.us is Official website of New Jersey Department of Labor. After filing an unemployment insurance claim, the next step is to claim benefits for a specific calendar week. To do this, you will be mailed a Claim for Benefits form that will contain the following information:

    • The calendar weeks (either one or two weeks) for which you are claiming benefits. Unemployment weeks begin on Sunday and end on Saturday. The weeks listed at the top of your form will have Saturday ending dates. There will normally be two weeks listed at the top of the form; however, depending on which bi-weekly schedule you are assigned, there may be times when only one week is printed.
    • The date to claim your benefits will be printed at the top of the form. You will be assigned a Wednesday to claim your benefits for the first time by using either the telephone or the Internet. After that, you will be asked to claim your benefits on a specific Monday or Tuesday. If you miss your assigned date, you should claim your benefits on the Wednesday, Thursday or Friday immediately following your assigned date. If you don’t claim your benefits as directed, benefits may be delayed or denied.
    • The telephone number and Internet address (www.njuifile.net ) will also be printed at the top of the form. Telephone numbers are assigned according to the One-Stop Career Center that provides reemployment services in your area. Occasionally, a technical problem may occur at the location you are calling. If that happens, you may call any of the other numbers assigned to the other offices.     Important: If there is a problem on your claim that must be resolved before benefits can be paid or if you have been denied benefits and are appealing the determination, you must still claim your weekly unemployment benefits. You will receive credit for the weeks that you have claimed. If it is determined that you are eligible for benefits or if you win your appeal, you will be paid these weeks at a later date. Note: Even if you win your appeal, you will not be paid for weeks that you have not claimed.

    If you have been laid off from your job, you should be able to file for unemployment online without visiting an unemployment office. In most states, unemployed workers can apply for unemployment benefits online, over the phone or, in some cases, by mailing a form.     Where to File an Unemployment Claim

    If you live in one state and work in another, or if you have moved, usually, you should file your unemployment claim with the state where you worked.

    If you worked in a state other than the one where you live or if you worked in multiple states, the state unemployment office where you now live can provide information about how to file your claim with other states.

    Information Needed to Apply for Unemployment

    Before you file, check with your state unemployment office to determine the best way to open a claim.

    Requirements may vary from state to state, but here is a sampling of the information you will need to have available when filing for unemployment:

    • Mailing address, including zip code
    • Phone number
    • Social Security number
    • Driver s License number (if you have one)
    • Veteran/Military separation date
    • Mother s maiden name (for security/access purposes)
    • Name, address, phone number of your last employer
