The Employment Training Administration (ETA), a division of the U.S. Department of Labor (DOL), is the so-called Federal unemployment office. It’s the main unemployment office so to speak, because each state unemployment office is an agent of the DOLETA in the nation’s Unemployment Insurance System.

The DOLETA Web site is a great place to generally research unemployment benefits and laws. It is not, however, the place to file a claim for unemployment benefits. The nearest state unemployment office or its Web site is the place to do that. Links to state unemployment office Web sites are listed below.

State Unemployment Office

As indicated above, the unemployment office Web site for the state in which you work is the place to file a claim for standard, extended or disaster unemployment benefits, if it has online facilities for such. Many do; but, regardless of whether or not they have online claim-filing facilities, state unemployment office Web sites provide instructions or contact information for filing claims by other means.

State unemployment offices also administer state disability programs in the few states that have such. If you’re unemployed due to an injury or illness unrelated to your job, then you might be eligible for one or more state disability programs instead of unemployment benefits.

If you’re unemployed due to an occupational injury or illness directly related to your job, then you might be eligible for workers’ compensation benefits administered by workers’ compensation agencies.

Can I Claim Benefit?

You can make a claim for Housing Benefit and Council Tax Reduction if:

  • You pay rent to a private landlord, housing association, or a council property. But you cannot claim Housing Benefit if you rent from close relatives or the landlord also lives in the same property. A close relative is a parent/step parent or sibling/step sibling. However, if the relative has a commercial tenancy agreement (ie they are a landlord who has let properties previously) then you may be able to claim
  • You have to pay Council Tax on your home. But if you live in a property that is band E or higher you will only be paid up to the amount for a band D property
  • Your savings are less than 16,000 for Housing Benefit and 6000 for Council Tax Reduction applications
  • You work full time or part time (employed or self-employed) and get a low wage
  • You get Benefit or Tax Credit managed by the Department for Work and Pensions, the Inland Revenue or any other low income.

The rules on claiming Housing Benefit and Council Tax Reduction for self-employed people, students, people from abroad and people who have savings are different to those who get Benefit or Pensions.

How Much Benefit Could I Get?

This is based on the amount of income and savings you have. The more you have the less you get. When we work out your Benefit we take into account:

  • How much money you have coming in each week

Working age – there will be a cap on the amount of benefits that you can get. The Benefit Cap forms part of the Welfare Reform Changes that came into force from April 2013. There are a number of benefits that are included in the Benefit Cap as well as a number of benefits and circumstances that will exclude you from having the cap applied. The Benefit Cap factsheet in Related downloads can explain this further.

If you are not excluded from the benefit amount cap, it will be set at:

  • 500 per week for couples and lone parents; or
  • 350 per week for single adults.
  • How much you have in savings and investments
  • Who lives in your household and their circumstances
  • How much rent and Council Tax you have to pay
  • Whether you are of pension age or working age
  • How many rooms you need for your household (Housing Benefit only).

Renting from South Essex Homes or Housing Associations

Working age – the amount that you are awarded for Housing Benefit depends on the number of rooms you are allowed for your family circumstances, this is known as Size Criteria . Size Criteria forms part of the Welfare Reform Changes that came into force from April 2013. If you are considered to have:

  • 1 extra bedroom you will have a 14% reduction on your Housing Benefit
  • 2 or more extra bedrooms you will have a 25% reduction to your Housing Benefit

You will have to make up the difference yourself. There are some groups of people that are excluded from having the size criteria applied to their claim. For further information about these groups of people please see the Size Criteria Factsheet 2014 in Related Downloads.

Renting from a Private Landlord

If you are working age or pension age the amount you get depends on the Local Housing Allowance rate for the size property you are claiming for. The rates and are updated yearly and can be found in the LHA Rates 2017/2018 Poster in Related Downloads.

Payment on Two Homes

Housing Benefit is normally only paid for one home at a time. However, there are some exceptions where the council may consider paying benefit on two homes. These exceptions are:

  • You have moved into rented accommodation due to fear of violence
  • You are a student/trainee, one of a couple and have to live in separate rented accommodation
  • You have a large family and the council has housed you in two properties
  • You have moved to a new home which you have to pay rent for, but still have to pay rent for a period of time on the old property. This is known as unavoidable overlapping liability.

How to Claim Unemployment Benefits

Wyoming unemployment claim

The purpose of unemployment insurance is to provide workers, who are unemployed through no fault of their own, with monetary payments for a specific period of time or until the worker finds a new job.

Unemployment benefits are provided by state unemployment insurance programs within guidelines established by Federal law. Eligibility for unemployment insurance, benefit amounts and the length of time benefits are available are determined by state law.

State Unemployment Benefits

Eligibility for unemployment insurance, benefit amounts and the length of time benefits are available are determined by state law and vary depending on where you live. Information on eligibility for state unemployment compensation is available on the state unemployment office website for your state.

The unemployment compensation you will receive will depend upon the amount you earned while working. In addition, there are eligibility requirements to qualify for unemployment benefits including working a certain number of weeks.

Regular unemployment benefits are paid for a maximum of 26 weeks, less in some states. In many states, the compensation will be half your earnings, up to a maximum amount. The maximum varies by location.

Federal Unemployment Benefits

There are no federal unemployment benefit programs in effect. Those benefits, known as an unemployment extension, provided additional weeks of unemployment compensation for the long-term unemployed.

Extended unemployment benefits, including Emergency Unemployment Compensation (EUC) and Extended Benefit (EB) programs were available to workers who had exhausted regular state unemployment insurance benefits during periods of high unemployment prior to 2014.

Unemployment Eligibility

In order to receive unemployment compensation, workers must meet the unemployment eligibility requirements for wages earned or time worked during an established (one year) period of time.

In addition, workers must be determined to be unemployed through no fault of their own.

Disqualification from Unemployment

The following circumstances may disqualify you from collecting unemployment benefits, depending on state law:

  • Quit without good cause
  • Fired for misconduct
  • Resigned because of illness (check on disability benefits)
  • Left to get married
  • Self-employed
  • Involved in a labor dispute
  • Attending school

Unemployment Benefits

  • Regular benefits are paid for a maximum of 26 weeks in most states. Some states provide benefits for fewer weeks.
  • In many states, the compensation will be half your earnings, up to a maximum amount.
  • Benefits are subject to Federal income taxes and must be reported on your Federal income tax return.

When to File

Filing for unemployment should be the first item on your agenda when you ve been laid off. It might take two or three weeks to collect a check, so the sooner you file, the faster you ll get paid. A delay in filing will mean a delay in collecting.

You may be able to file for unemployment online or over the phone. Review the information you will need to open a claim. Then, visit your state unemployment office to determine the best way to open a claim and to get started collecting unemployment.

In general, to file a claim you will need:

  • Social Security Number
  • Alien Registration Card if you re not a US citizen
  • Mailing address including zip code
  • Phone number
  • Names, addresses and dates of employment for all your past employers for the last two years

Getting Paid

  • It generally takes a few weeks after your claim to receive your first unemployment benefit check, direct deposit or debit card. Some states require a one-week waiting period; therefore, the second week claimed is the first week of payment.
  • Once your claim is approved, you should be able to file weekly online, by phone or by mail.

Unemployment When You Quit

Can you collect unemployment if you quit your job? It depends. In most cases, if you voluntarily left employment you are not eligible. However, if you left for good cause you may be able to collect.

Good cause would be determined by the state unemployment office and you will be able to make a case for why you are eligible for benefits. If your claim is denied, you should be entitled to a hearing where you can plead your case.

However, in some situations, the only way to get a definitive answer or clarification is to talk to an actual person. The FAQ sections of most state unemployment websites don t cover all circumstances, and unemployment claims can be complicated.

Phone numbers are usually listed in the Contact Us section of your state unemployment office website.

A quick and easy way to find a telephone number or email address for your unemployment office is to search Google using your state s name, unemployment office and phone number. For example, searching Google for New York unemployment phone brings me directly to the contact information page for the NYS Department of Labor s Unemployment Insurance contact page.

If English is not your first language, some states have telephone claims lines in other languages. For examples, California provides separate phone numbers for English, Spanish, Cantonese, Mandarin, and Vietnamese speaking customers. If available, information on alternative phone numbers will also be listed on the contact page for the unemployment office.

You may also be able to contact claims staff by email, but do not send any confidential information in your email message.

The Best Time to Call

If you are having difficulty connecting with a representative, the best time to call unemployment without having to be on hold for a long time is later in the week, and either early in the morning or late in the afternoon.

WHO urges global action to curtail consumption and health impacts of sugary drinks

11 October 2016 | GENEVA – Taxing sugary drinks can lower consumption and reduce obesity, type 2 diabetes and tooth decay, says a new WHO report.

Fiscal policies that lead to at least a 20% increase in the retail price of sugary drinks would result in proportional reductions in consumption of such products, according to the report titled “Fiscal policies for Diet and Prevention of Noncommunicable Diseases (NCDs)”.

Reduced consumption of sugary drinks means lower intake of “free sugars” and calories overall, improved nutrition and fewer people suffering from overweight, obesity, diabetes and tooth decay.

Free sugars refer to monosaccharides (such as glucose or fructose) and disaccharides (such as sucrose or table sugar) added to foods and drinks by the manufacturer, cook, or consumer, and sugars naturally present in honey, syrups, fruit juices, and fruit juice concentrates.

Obesity on the rise

“Consumption of free sugars, including products like sugary drinks, is a major factor in the global increase of people suffering from obesity and diabetes,” says Dr Douglas Bettcher, Director of WHO’s Department for the Prevention of NCDs. “If governments tax products like sugary drinks, they can reduce suffering and save lives. They can also cut healthcare costs and increase revenues to invest in health services.”

In 2014, more than 1 in 3 (39%) adults worldwide aged 18 years and older were overweight. Worldwide prevalence of obesity more than doubled between 1980 and 2014, with 11% of men and 15% of women (more than half a billion adults) being classified as obese.

In addition, an estimated 42 million children aged under 5 years were overweight or obese in 2015, an increase of about 11 million during the past 15 years. Almost half (48%) of these children lived in Asia and 25% in Africa.

The number of people living with diabetes has also been rising, from 108 million in 1980 to 422 million in 2014. The disease was directly responsible for 1.5 million deaths in 2012 alone.

Need to reduce sugar intake

“Nutritionally, people don’t need any sugar in their diet. WHO recommends that if people do consume free sugars, they keep their intake below 10% of their total energy needs, and reduce it to less than 5% for additional health benefits. This is equivalent to less than a single serving (at least 250 ml) of commonly consumed sugary drinks per day,” says Dr Francesco Branca, Director of WHO’s Department of Nutrition for Health and Development.

According to the new WHO report, national dietary surveys indicate that drinks and foods high in free sugars can be a major source of unnecessary calories in people’s diets, particularly in the case of children, adolescents and young adults.

It also points out that some groups, including people living on low incomes, young people and those who frequently consume unhealthy foods and beverages, are most responsive to changes in prices of drinks and foods and, therefore, gain the highest health benefits.

Using fiscal policies to reduce consumption

Fiscal policies should target foods and beverages for which healthier alternatives are available, the report adds.

The report presents outcomes of a mid-2015 meeting of global experts convened by WHO and an investigation of 11 recent systematic reviews of the effectiveness of fiscal policy interventions for improving diets and preventing NCDs and a technical meeting of global experts. Other findings include:

  • Subsidies for fresh fruits and vegetables that reduce prices by 10–30% can increase fruit and vegetable consumption.
  • Taxation of certain foods and drinks, particularly those high in saturated fats, trans fat, free sugars and/or salt appears promising, with existing evidence clearly showing that increases in the prices of such products reduces their consumption.
  • Excise taxes, such as those used on tobacco products, that apply a set (specific) amount of tax on a given quantity or volume of the product, or particular ingredient, are likely to be more effective than sales or other taxes based on a percentage of the retail price.
  • Public support for such tax increases could be increased if the revenue they generate is earmarked for efforts to improve health systems, encourage healthier diets and increase physical activity.

A number of countries have taken fiscal measures to protect people from unhealthy products. These include Mexico, which has implemented an excise tax on non-alcoholic beverages with added sugar, and Hungary, which has imposed a tax on packaged products with high sugars, salt or caffeine levels.

Countries, such as the Philippines, South Africa and the United Kingdom of Great Britain and Northern Ireland have also announced intentions to implement taxes on sugary drinks.

Notes to editors:

As part of comprehensive policy measures to improve health, WHO calls on governments to use fiscal measures in its “Global Action Plan on the Prevention and Control of NCDs 2013–2020”, the “Comprehensive Implementation Plan on Maternal , Infant and Young Child Nutrition” and more recently by the WHO Commission on Ending Childhood Obesity.

In 2012, 38 million people lost their lives due to NCDs, 16 million or 42% of whom died prematurely – before 70 years – from largely avoidable conditions. More than 80% of people who died prematurely from a NCD were in developing countries. Governments had committed to reduce deaths from NCDs, and the 2030 Sustainable Development Agenda includes a target to reduce premature deaths from diabetes, cancers, heart, and lung diseases by one-third by 2030.

At the Second International Conference on Nutrition in 2014, governments committed to reshape food systems, and this is the main goal of the recently declared UN Decade of Action of Nutrition 2016-2025.

The Workers’ Compensation Claim Process

Most employers are required to carry workers’ compensation, or workers’ comp, insurance to cover employees who are injured on the job. Employees do not have to prove fault in order to recover, but benefits are not automatic. Specifics of the workers’ compensation claims process vary by state, but injured employees generally must notify their employer and the workers’ comp carrier. Regardless of state laws, however, injured employees are always encouraged to obtain any necessary medical treatment first.

Assuming you’ve already received medical attention, the workers’ compensation claim process involves several important steps. You must notify your employer in writing; fill out an official claim form (which should be provided by your employer); and keep detailed records about your treatment.

Get Immediate Medical Attention

Before filing a workers’ comp claim, make sure you get the necessary medical treatment. Some workers’ comp policies require injured employees to see a specified doctor, so you may want to ask your supervisor. But many state laws allow you to get a second opinion if you are not satisfied with the first one. Even if you don’t feel the need to get medical attention, it may be a requirement for the workers’ compensation claim process.

Keep in mind that a medical report will serve as an official record of your injuries and the basis for any workers’ comp reimbursement.

Notify Your Employer

Make sure you notify your employer about the injury within the statutory deadline, preferably soon after the injury occurs. In New York, for example, an employee has 30 days in which to notify their employer about a job-related injury. It’s a good idea to report all workplace accidents even if you don’t suspect an injury, just in case an injury is discovered after the deadline expires.

As with any legal process, make sure you notify your supervisor in writing. Even if you give verbal notification first, a written follow-up notification will provide an official record. The sooner you do this, the more details you will be able to recall.

Your employer probably will give you an official claim form as part of the workers’ compensation claim process. But if not, you should request one from the workers’ compensation board of your state. Generally, you will need to provide the following information on your workers comp claim form:

  1. Type of injury and affected areas of the body;
  2. Date, time, and location of injury;
  3. Parties involved in the accident;
  4. How the accident occurred; and
  5. Any medical treatment you have received

Workers’ Comp Claim Process: Employers’ Responsibilities

Employers that are required by law to provide workers’ comp coverage face the prospect of fines, criminal charges, and lawsuits if they fail to do so. Also, employers may not retaliate against a worker who claims workers’ comp. Therefore, employers have strong incentives to comply with the law and complete all valid claims.

Usually, your employer will file your claim with its insurer and the state workers’ comp board office. After your claim is evaluated by the insurer, an administrator will notify you about whether your claim has been accepted and the amount of benefits to which you are entitled.

After the Claim

Most of your involvement with the workers’ compensation claim process is complete after filling out the necessary paperwork. But you still want to follow up on your claim and make sure you keep detailed records. For instance, you may want to keep a journal of how the injury affects your work and day-to-day activities. Also, be sure to keep receipts for out-of-pocket expenses and proof of any other hardships caused by the injury.

If your claim is rejected, you will have the opportunity to appeal in most cases.

    CDIC covers bank accounts in Canada. Each account is covered up to $100,000.00. That’s it! If PC Financial went under CDIC would be the entity covering your PC Financial deposit, up to $100,000.00. For that matter, if CIBC went under CDIC would be the entity covering any CIBC deposit account , again up to $100,000.00.

    There are ways round this — accounts held individually are separate from accounts held jointly. For more detailed info see this link to CIDC’s website..

    And from the latest (January 2013) privacy policy: “. to your PC Financial personal banking products. which are provided by the direct banking division of CIBC . “.

    One would assume if PC Financial was in trouble and CIBC would take over . but another institution could also take over . and keep in mind what assume means . lol.

    Being proactive, I would consider not going over 90,000 in any CDIC institution and find other CDIC high interest institutions (only if you are comfortable with them) to deal with as well or a Credit Union as they are usually unlimited. Take a look at what your province CU’s have to offer, Winnipeg CU’s as well.

    Also keep in mind that some CU’s (BC for sure) offer insurance on US dollar accounts while CDIC does NOT.

    Depending on how many accounts you have at PC like savings, chequing, TFSA, RRSP etc. Sometimes they say that a joint account may be covered for 100000 and a TFSA for another 100000 etc. . something you need to verify on the CDIC site.

If you have accounts in the same ownership (i.e., sole with same Social Insurance Number – not joint with one and sole with another) with both companies, the CDIC deposit limits would be the same and I believe CIBC’s and PCF’s deposit insurance disclosure pages on their websites reflect this.

    I just wanted to clarify this as this is an important distinction that must be spread incorrectly.

    That said, deposits with a “Big 5” bank like CIBC really don’t need deposit insurance. The whole deposit insurance scheme is reassurance we don’t really need and meant for the smaller institutions. If CIBC had failed completely, the world and Canada would be in a very sorry state, everyone would’ve already rushed to traditional safe havens like gold and mattresses and we’d all be building underground bunkers and protecting our personal property with various traditional means, if you know what I mean. These steps are valid in most situations and there is no right order to take (note: if you need to file a claim against the government or a government agency, there are other specific steps that should be taken).

    • Collect evidence that can point to who caused the accident, as well as the damage caused by the accident. Photographs are useful here.
    • Write down everything that has happened to you after the accident. This may include things like medical bills, hospital visits, any lost work or wages, etc.
    • Be sure to get the names and contact information of any witnesses that may have observed the accident. Contact these people to confirm their contact information.
    • If you speak to other people that were involved in the accident, be sure to take notes about your conversation.

    How long do I have to notify a person that I am filing a claim for my personal injury?

    If you are planning on filing suit against an individual or some other entity that is not the government or a government agency, there is not set time limit in which you have to notify that person of your intention to file a lawsuit. However, this does not mean that you should take your time with the matter. By acting quickly and efficiently, you will probably increase your chances of resolving your claim faster than if you delay.

    It is good to keep in mind that even though you notify people of your intent to file a lawsuit, this does not mean that you must file a lawsuit. By giving notice, you only preserve your rights and prevent the other parties from defending against a lawsuit by arguing that you waited too long to inform them of your injuries. By notifying the other parties, you simply ensure that you can proceed with negotiations regarding settlement and arbitration at your own speed, without feeling rushed.

    A back injury claim allows you to get compensation from the person or business that is legally responsible for causing your injuries, or the underlying accident that led to your injuries. Since back injuries can range from strains and sprains to spinal cord injuries and paralysis, the settlement value of any given claim must be determined on a case-by-case basis. However, there are some general guidelines that apply when assessing the settlement value of a back injury claim, and this article offers some tips to keep in mind.

    Typical compensation for a back injury claim includes both economic and non-economic damages (which are usually grouped together as a single award of “compensatory damages”). Let’s take a closer look at both types of damages in a typical back injury case, as well as other forms of financial recovery that may be available.

    Economic compensatory damages (sometimes called special damages) are actual financial losses due to money spent — or money you are not able to earn — because of your injury. Potential economic compensatory damages in a back injury claim include:

    • Past and Future medical bills: These will vary based on the severity of your injuries. For a herniated disc, a surgery costs about $6,000 on average (this according to a 2006 report in USA Today, so current costs are likely a little higher). X-rays, which are often required even for minor strains and sprains, can cost from around $100 to more than $1,000, while physical therapy will likely cost at least $100 per session. In cases involving serious spine injuries and paralysis, the cost of future medical care (lifelong in some cases) can be millions of dollars.
    • Lost income and wages: In a back injury claim, you’re entitled to compensation for any lost income and expected future reduction in your earning capacity. Lost wage damages are determined by an examination of your salary history and the amount of work you missed, including sick time or vacation time. Lost future income (or loss of earning capacity) is calculated under a complex formula that includes assessment of your projected earnings and the impact your back injuries will have on your ability to do any kind of work.

    Non-Economic Compensatory Damages

    Non-economic compensatory damages (sometimes called general damages) provide compensation for non-monetary losses associated with the effects of your back injuries — losses that aren’t always easy to put a dollar value on. Non-economic compensatory damages typically include:

    • Pain and suffering: A pain multiplier is often used to assess pain and suffering damages. That means your economic compensatory damages (i.e. medical expenses and lost wages) will be multiplied by a set number (between 1.5 and 5, for example) although in cases of serious injury, the multiplier may be significantly higher (10, for example).
    • Emotional distress: When applicable, emotional distress damages may be assessed separately or compensated as part of pain and suffering, depending on state law.
    • Loss of consortium. When back injuries are so serious (as in cases of partial or total paralysis, for example) that the victim’s loved ones (spouses and children) are deprived of a normal loving relationship and companionship (including the loss of a marital sexual relationship in the case of a spouse), loss of consortium damages may be awarded. In some states, these damages are included as part of a back injury victim’s compensatory damages award. Elsewhere, affected family members must sue separately for loss of consortium damages.

    Punitive Damages

    In rare circumstances, punitive damages may be awarded in a back injury case. But there must be proof that the defendant’s action or inaction in causing the accident amounted to more than just run-of-the-mill negligence, and even then, punitive damages are usually only awarded after the case has gone through a full civil trial and a jury has decide that punitive damages are appropriate. The defendant’s conduct must be considered so outrageous or egregious that payment of additional damages is justified — not in order to compensate the back injury victim, but to punish the defendant’s behavior.

    Other Factors That May Affect the Value of Your Back Injury Claim

    While the severity of injuries is the major determining factor in the value of a back injury claim, two other considerations can also affect the amount of compensation received in a settlement or jury verdict. These include:

    • Comparative/contributory negligence: In a small minority of “contributory negligence” states, you recover nothing at all if you were partially at fault for causing the incident that resulted in your injuries. In the majority of states, a different rule called “comparative negligence” applies, and you may be able to recover as long as the other party was at least 50 percent or 51 percent responsible (states have different rules on the required fault percentage). Your damages award will be reduced by the amount of responsibility that you bear (so if you’re deemed 20% at fault, you’ll only collect 80% of your total damages).     • Failure to Mitigate Damages: After an accident, you are required to take reasonable steps to mitigate your damages. For instance, let’s say you suffer a back sprain and your doctor prescribes a compression brace for you to wear for up to 12 hours a day. But you don’t wear the brace at all (in fact, the defendant can prove you never even picked it up from the pharmacy), and your injuries become worse. Since you could have taken reasonable steps to treat your injuries, but chose not to, the defendant will almost certainly be off the hook for at least a portion of your damages.

    When dozens of men stormed the Shanghai branch of USGFX, an Australian foreign currency trading firm, in July, the employees were terrified. Held hostage as assailants sealed the exits, the 20 employees — all Chinese — had their phones seized and only got food and water after they begged for sustenance. While 17 of the staff were freed within 24 hours, the remaining three were held for five days.

    But despite the hostage drama, there were no SWAT vans at the premises, nor did local media show any interest. The company tried in vain to get the police involved, with initial reports suggesting that up until the day the situation was resolved, the police presence was limited to a visit by a few — possibly just one — officers from the local economic crimes unit.

    In China, where it’s utterly unremarkable for one side to take hostages when financial disputes crop up, the story was no more interesting than a civil lawsuit. Given how reticent the authorities are to intervene, taking hostages is frequently seen as a better route than appealing to the courts. In fact, the courts are sympathetic to certain types of hostage taking: When debt is involved, the law considers it a lesser offense than taking hostages for ransom, and it is classed as “unlawful detention” instead. In practice, police often don’t even consider it to be an offense at all.

    In 2010, one government hospital even refused to hand over a newborn baby to his parents so they would pay up for the birth costs. The baby was kept in the hospital for more than three months.

    “Virtually all of the time, the police studiously seek to avoid getting involved,” said Dan Harris, a high-profile lawyer who specializes in Chinese law. “They see their job as maintaining social harmony.”

    “The most common reason, by far, for someone to get taken hostage is when their company allegedly owes money to a Chinese company. They are typically resolved by the foreign company paying every dollar allegedly owed,” he said. “I am not aware of any instance in which there has been a compromise. Sometimes, though, when a company pays enough, we can line up a team and free the hostage.”

    It makes a lot of sense for Chinese police to avoid getting involved in financial disputes, even when hostages are taken. One side of the dispute might be connected with a local government office or powerful business. Even if they’re not particularly powerful, they could launch protests, and the police might be blamed. It’s also fairly cheap and easy for one side to hire thugs, who may be better prepared for a fight than the police.

    But the police are also predisposed to see it as none of their business. Public security is broken into two areas: minshi and xingshi. Translated loosely, they can be considered civil and criminal issues, respectively. When it’s a financial dispute, rather than a hostage taken for ransom, police generally consider it more of a minshi issue and thus more in need of mediation than law enforcement, if it requires any police input at all. Debt kidnappings aren’t the only situation this applies to: Even in fights with quite serious injuries, the police often attempt to negotiate a payoff to the injured party instead of bringing charges.

    The theme of the wise official mediating among disputants has long been a staple of Chinese literature. In the modern context, the strangeness of the police’s dual role as social mediators and law enforcers has been noted by Fordham University professor Carl Minzner. Minzner attributes it to the authoritarian system’s top-down approach to dealing with tensions between citizens and the state and to the Chinese Communist Party’s refusal to allow the development of independent legal bodies that could deal with such disputes.

    Harris’s China Law Blog repeatedly stresses the risks of being taken hostage in China over debts. In many cases, the best move for foreigners facing such circumstances is simply to get out of the country before the thugs reach you.

    Often, precious little can be done to protect alleged debtors from thugs, and the courts and the police are of little help. This helplessness was on full display when two Indian businessmen were taken hostage for 20 days in the Chinese trading hub of Yiwu in 2012. The case came to a head when a court ordered that the two businessmen — who had been taken to court by the angry locals who had seized them — be released. The enraged mob proceeded to ignore the ruling. Authorities later managed to spirit the two men to Shanghai while the case was processed.

    The case, of course, stirred up alarm in India — not least because an Indian diplomat sent to try to resolve the situation became caught in a violent fracas and was subsequently hospitalized. But Chinese authorities were, and still are, ill-equipped to understand the foreign perspective on these cases. Nationalistic Chinese tabloid the Global Times was oblivious to the root cause of Indians’ distress and was instead content to chalk it up to nationalism. The editors couldn’t grasp that most countries don’t see kidnapping as a legitimate response to debt.

    As for the people who decide to take hostages, there are a pretty clear set of incentives — sometimes it works. In 2015, when investors around the country were left high and dry by Fanya Metal Exchange — a fraudulent government-backed trading scheme that was even advertised by staff of top banks — they formed a mob and grabbed the CEO, Shan Jiuliang, themselves, delivering him to police custody. In that instance, he was not arrested, but investor representatives managed to extract promises from him regarding their investments.

    There are, of course, limits to taking hostages without a police backlash. If those taking the hostages are wielding weapons or take innocent bystanders captive, they are far more likely to draw attention from the police. In 2015, a desperate Gansu man leapt in a car in Nanchang, Jiangxi province, and took the driver hostage with a knife and commanded the driver to take him to the police. He was angry because his boss owed him money, but lacking any clues as to the whereabouts of said boss, he grabbed a random driver instead. He ordered the driver to call the police but ended up arrested himself and spent six months in prison.

    The lack of police involvement in these debt-hostage situations, coupled with the economic downturn, makes China a ripe environment for loan sharks. One case that occupied headlines this year involved a debt collector who hired a gang of thugs to terrorize a 23-year-old man named Yu Huan and his mother to get a debt repaid. The police did not intervene, and Yu ended up grabbing a knife and killing one of the attackers after they pushed his mother’s head into the toilet.

    Yu was initially sentenced to a life sentence, though this was reduced to just five years after a public outcry. The Southern Weekly newspaper suggested at the time that the death had only occurred after police had left the scene of the scuffle, leaving Yu desperate. Yu’s attorney indicated during the proceedings that they were considering suing the police for dereliction of duty.

    This, it would seem, was finally enough to spur police action.

    The authorities examined the case and exonerated all the police involved, saying they had only left to call for backup.

    The Town of Washington Court hears formal civil cases when either the Plaintiff or the Defendant resides in, is employed in or has a place of business within the Town.

    Defendants are not guaranteed legal representation in civil court as they are in criminal court but may retain legal representation.     VEHICLE AND TRAFFIC COURT

    Cases charging the commission of a traffic infraction within the town limits are filed in the Town of Washington Justice Court. Information regarding how to proceed with a traffic ticket may be found on the back of the ticket issued to the motorist. If the motorist responds by pleading not guilty, the Court Clerk will schedule a trial. The Court conducts non-jury or bench trials for violations, offenses and vehicle and traffic cases. If the motorist pleads guilty by mail, a fine letter will be issued that instructs the defendant on procedure and amount of payment.

    The Court hears small claims cases up to a maximum amount of $3000 when the Defendant resides in, is employed in, or has a place of business within the Town. Individuals and sole proprietors of businesses may bring a suit against an individual, corporation, partnership, association or assignee in Small Claims Court by filing a claim with the Court. There is a filing fee of $10 for claims up to $1000 and $15 for claims up to $3000. You may not file a claim in Small Claims Court for over $3000. Small Claims Court is intended to provide a simple, informal and inexpensive procedure for prompt determination of small claims.

    The Court hears Summary Proceedings/Evictions when the property and the Respondent are located within the Town. These proceedings include non payment of rent or holdover evictions. Plaintiffs may claim the full amount in dispute as there is no limit on the amount of the claim for which the Court has civil jurisdiction in such cases. The Court hears both residential and commercial landlord/tenant cases.

    The Town of Washington Court hears criminal cases originating within the Town and has full jurisdiction for non-felony cases (misdemeanors and violations) to accept guilty pleas or hold trials. On felony charges, the court conducts the arraignment and preliminary inquiry and may set bail or hold without bail. If the charges are not reduced to misdemeanors, the Town Court transfers them to Dutchess County Court for final disposition. The Town Court may not accept pleas in felony cases.

    Defendants have the right to legal counsel and to choose a jury trial or non-jury trial for misdemeanor cases. The Dutchess County Public Defender s Office provides legal services to criminal defendants who have been determined to be indigent.

    How Is Unemployment Determined in New Jersey

    Nj unemployment claim statusNew Jersey’s Department of Labor and Workforce Development administers the state’s unemployment’s insurance plan. The idea of this insurance is to give relief to out-work-citizens while they search for new employment. Businesses with employees pay into the unemployment insurance plan and the department offers benefit payments to eligible individuals. State laws decide how much you can obtain on New Jersey unemployment and the procedures for the process.

    If you have filed for jobless benefits in NJ, you may speculate how your benefits are estimated. The state of New Jersey has very specific rules to work out the weekly benefit amounts of individuals eligible for unemployment benefits. How much you receive in benefits will depend on your past employment, wages earned and your dependents.

    Identify Your Base Period

    The Labor and Workforce Development employs your base period to decide eligibility and then to compute your benefit amount. It’s the 1st four of the last five full calendar quarters you filed for benefits.

    Your regular base period comprises 52 weeks that is determined by the date of your claim. The table below shows what your regular base period would be if you filed your claim any day between January 1, 2012 and December 31, 2012.

    In case you do not meet the above necessities but you have worked no less than 770 hours in employment involving the production and harvesting of agricultural crops during your base year, you may still be qualified for benefits.

    If you do not meet the above requirements but you worked at least 770 hours in employment involving the production and harvesting of agricultural crops during your base year, you may still be eligible for benefits.

    Alternate Base Year Period

    Sometimes when a claimant does not have sufficient wages to be eligible for benefits in the base period, the LWD allows the alternate base period. That’s just the last 4 full calendar quarters prior to filing your claim. Whichever base period you employ to qualify for benefits is the one you must use when computing your benefits.

    You may qualify for benefits if you worked at least 20 base weeks (a base week in 2010, 2011, and 2012 is minimum weekly earnings of $145), or a total of $7,300 in any one-year period in the last 1 1/2 years (last 18 months)for a claim dated in calendar year 2010.

    There are two alternate base years (1 year periods) within the last 18 months that we check to qualify you for a claim. You cannot decide which alternate base year or which calendar quarters to use to be eligible for a claim. In case you still do not qualify for a claim using the 1st alternate base year, then the unemployment department checks using the 2nd alternate base year.

    Alternate Base Year #1: The first alternative uses your four most recent quarters prior to filing your claim.

    Alternate Base Year #2: The second alternative uses your three most recent quarters prior to the date of filing your claim, and weeks in the quarter you filed your claim. This alternative base year will contain less than 52 weeks.

    The LWD examines your base period wages; it only reflects the wages from employment covered under the New Jersey unemployment compensation laws. These wages are called insured or covered wages. Similar to most states, New Jersey’s unemployment rules are complete. Some important exclusions take in independent contractor work, commission only work and self-employed work.

    Calculating Your Weekly Benefit Amount

    Average-Weekly-Wage Formula: Numerous states calculate the weekly benefit as a percentage of the worker’s average weekly wages in the base period.

    Formula for calculating weekly benefit amount:

    60% (base weeks’ wages/number of base weeks) +DA (Dependent’s Allowances)

    Your weekly benefit amount is 60% of your average weekly wage during your base period. Sum your covered wages earned during your whole base period.

    Keep in mind that if your calculations put you above that, you still won t receive more than that.

    Calculating Your Maximum Benefit Amount (MBA)

    After you identify your WBA, you can determine your MBA, which is the total sum you can obtain per claim per benefit year. In order to decide your MBA, first determine your base weeks, which are weeks in your base period that you earned more than 20 times the state’s minimum wage.

    Your MBA is actually equal to your WBA multiplied by the number of weeks you worked.

    For instance, if you worked 22 weeks during your base period and your WBA is $400, your MBA is $8,800. This is the overall dollar amount you will collect during your benefit year. The highest number of weeks used to estimate your MBA is 26.

    Nj unemployment claim statusAll states need a worker to have earned a definite amount of wages or to have worked for a definite period of time (or both) within the base period to be financially eligible to collect any UI benefits. Most workers are entitled for benefits based on employment and wages in a single state. On the other hand, some workers who work in more than one state will not have sufficient employment and wages in any single state to set up monetary eligibility, or would be qualified for a smaller WBA. Workers with wages and employment in more than one state can opt to file a claim combining wages and employment earned in all states where they worked into a claim filed under the law of any of the states they worked.

    The qualifying formula for wages and employment used by New Jersey is:

    20 base weeks (20% of AWW)

    or alternative: 1,000 times the state minimum hourly wage. ($7.25/hr state minimum hourly wage)

    The minimum wages needed to qualify for UI in New Jersey is $2,900 for base period.

    New Jersey permits individuals with WBA less than the maximum weekly benefit amount of $598 to possibly be eligible for dependency benefits. Dependency benefits let you to collect additional money for your dependents. If suitable, you will be given 7% of your WBA for your first dependent and 4% for your next two dependents. The maximum percentage you can claim is 15% for three dependents.

    You can t collect dependency benefits if your spouse or civil union partner is working during the first week you file your claim. To claim a dependency, your child must not have married and must be under the age of 19, or 22 if a full-time student. You can claim your spouse or civil union partner as a dependent if he or she is unemployed. You must give the Social Security number of your spouse or child and give proof of dependency within 6 weeks of filing your claim.

    Nj unemployment claim statusBased on the type of pension you get, it may affect your unemployment benefits. According the New Jersey Department of Labor, if your employer made 100% of the contribution to your pension, 100% of your weekly pension amount is subtracted from your weekly benefits. If both you and your employer contributed equally to your pension, 50% of your weekly pension amount is taken away from your WBA. If you contributed 100% to your pension, you will not have your benefits reduced. Your benefits are delayed if you receive a lump sum payment of a retirement pension due to an involuntary separation of work before the age of 59 1/2. In case you collect Social Security benefits, you will not experience a reduction of your unemployment benefits.

    The Pacific razor clam (Siliqua patula) is an exceptionally meaty shellfish which ranges from California to Alaska. It is abundant on surf-pounded ocean beaches, but also occurs in sheltered areas along the coast. Limited diving observations have indicated some adult razor clams (S.patula) offshore for up to one-half mile. Razor clams dredged in water deeper than 30 feet, although similar to the beach clam, are a different species (Siliqua sloati).

    In Washington waters, the razor clam grows to a maximum length of six inches, although they are seldom found. Clams seven inches long have been recorded, but are very rare. The life expectancy for Washington clams is five years. Again, there are exceptions, but razor clams suffer from a high degree of mortality due to predation by Dungeness crabs, shore birds, numerous species of fish and of course thousands of clam diggers. A disease was also discovered in the early 1980’s that caused mass mortalities of large numbers of clams. It is unknown how long this disease has affected clam populations. In contrast, razor clams found in Alaska may grow to eleven inches in length and live to be 15 years old, due to colder water temperatures and slower growth rates.

    Razor clams are found primarily on the intertidal coastal beaches (those that are exposed at low tide) from a +3 foot level to a -2 foot tide level. The Washington Department of Fish and Wildlife (WDFW) divides the harvest areas into five major management zones (see map):

    • Long Beach from the Columbia River north to the mouth of the Willapa Bay
    • Twin Harbors from Willapa Bay north to the south jetty at the mouth of Grays Harbor
    • Copalis Beach from the north jetty at the mouth of Grays Harbor to the Copalis River
    • Mocrocks from the Copalis River to the south boundary of the Quinault Indian Reservation and
    • Kalaloch from the South Beach campground north to ONP Beach Trail 3. (This beach is closed to harvest until further notice)

    Other areas where razor clams exist are: a series of sand spits in the mouth of Willapa Bay, the Quinault Indian Reservation and numerous small beaches north of Olympic National Park (ONP) Trail 3 at Kalaloch. The sand spits in Willapa Bay are referred to as the Willapa Spits and are used for commercial harvest.

    Recreational Razor Clam Fishery

    The Pacific razor clam is one of the most sought after shellfish in the state of Washington. Better roads and more leisure time have brought increasing numbers of diggers to the ocean beaches. It is not unusual to have as many as a thousand people per mile during a nice spring weekend day. In past years, upwards of 300,000 individuals made 650,000 to 775,000 digger-trips to the ocean beaches and harvested 6 to 13 million razor clams. Since the mid-eighties, those numbers have been greatly reduced to only 250,000 digger trips harvesting 2.5 to 3 million clams. The reduction in the clam harvest was a direct result of decreased clam population levels, thought to be caused by historical over harvest and disease.

    Recreational digging for razor clams is truly a family sport. It can be enjoyed by children and senior citizens alike. All you need is a clam shovel or specialized tube, a container to put your clams in and most important, your clam license. Be sure to check the Fishing in Washington Regulation Page for the latest regulation requirements for clam digging and other sport fishing regulation updates. During the fall and winter when low tides occur at night, thousands of clam diggers brave the elements to dig by lantern or flash light. Because there is a great deal of interest in digging at all times of the year, seasons are set to allow digging during daylight spring tides when there is better weather and during the fall/winter when diggers have to deal with the elements, but not as many clam diggers.

    During certain times of the year, marine toxins, produced by some species of diatoms (algae) are taken in by razor clams and concentrated. When ingested, these toxins can cause illness and in very high concentrations can be fatal to humans. The WDFW in cooperation with the Washington Department of Health (DOH) sample clams on a routine basis. If high toxin levels are detected, clam seasons are delayed or closed. WDFW and DOH work very hard to provide a safe and fun resource to enjoy.

    Já escrevemos um artigo a respeito da primeira parte deste versículo. Agora, gostaríamos de refletir a respeito da segunda , que diz: “ invocai-o enquanto está perto.”

    Novamente, como no primeiro texto, chamamos a atenção para a palavra enquanto, que nos dá uma determinação de tempo, ou seja, a Palavra está nos dizendo que podemos invocar o nome do Senhor, num determinado momento, e Ele não está mais perto de nós.

    Se formos ao dicionário e procurarmos o sentido da palavra invocar, encontraremos como resposta: chamar em auxílio, pedir proteção. Porém invocar o Senhor é muito mais do que isto, quando invocamos o nome de Deus, estamos reconhecendo que percebemos o Seu poder salvador, estamos demonstrando para Ele que precisamos Dele, que confiamos Nele.

    Sendo assim, seria interessante que olhássemos o Salmo 145.18; “ Perto está o Senhor de todos os que o invocam, de todos os que o invocam em verdade”.

    Olhando para este versículo poderíamos dizer, até, que existe uma certa confusão. O profeta Isaías nos diz para invocar o nome do Senhor enquanto Ele está perto, nos dando um claro entendimento que poderemos fazer isto, num determinado instante, e Ele não estar mais próximo de nós.

    Já o versículo 18, do Salmo 145, nos diz que Ele estará perto de todo aquele que o invocar.

    Em primeiro lugar não existe confusão alguma, a Palavra é muito clara. Realmente, Ele poderá não estar mais perto, desde que não venhamos a invocá-Lo. O profeta Isaías está nos alertando para o fato de que existem pessoas, que vivem deixando para depois o momento de clamar ao Senhor.

    Estas pessoas acham que esta possibilidade estará sempre a nossa inteira disposição e o alerta, é de que, infelizmente, chegará um momento que esta possibilidade deixará de existir.Este momento ninguém sabe, somente o Senhor, porém está muito claro que este perigo existe.

    Já o Salmo 145.18 vem confirmar tudo isto, isto é, o Senhor estará sempre perto daqueles que O invocam, ou seja, se estas mesmas pessoas pararem de adiar este momento, colocar Deus, realmente, como prioridade e começar a clamar, Ele estará sempre perto.

    Porém existe uma condição para que isto venha a acontecer, qual seja, desde que O invoquemos em verdade, ou seja, de todo o nosso coração.

    Sendo assim, olhando de forma fria para o contido neste versículo, estamos vendo algo assustador, ou seja, podemos buscar o Senhor e não mais achá-lo e podemos invocar o Seu nome e Ele não estar mais por perto.

    Entretanto estamos vendo, também, algo maravilhoso, já que o texto está nos dizendo que todo aquele que buscar o Senhor o encontrará e Ele estará perto de toda pessoa que invocar o Seu nome, desde que, estas duas ações, sejam executadas em verdade, de todo o coração, de forma sincera, com uma entrega total.

    É muito importante ressaltar que buscar o Senhor é uma decisão nossa, querer Ele perto ou longe, somos nós que determinamos.

    Podemos continuar dando prioridade a outras coisas e achando que no momento mais propício, no momento que entendermos ser o mais adequado, daremos início ao processo de aproximação com Deus.

    O grande problema é que ninguém sabe qual o seu tempo. Sim, pois desde o momento que está escrito que existe a possibilidade de Ele não ser achado e não estar mais perto, significa dizer, que existe um tempo determinado para cada pessoa.

    O importante é que estas duas ações nos levam a Salvação e, como vimos, não existe nenhuma garantia de que quando acharmos conveniente começar esta busca, conseguiremos alcançá-la.

    Por isto é que precisamos começar agora, já, neste momento, pois quanto mais adiarmos, mais aumentamos os nossos riscos de ficar para trás.

    É uma questão de prioridade. A escolha é nossa.

    Accident Claim Payout

    What payout are you entitled to if you are injured in an automobile accident?

    Actually, after motor vehicle accidents that were caused by someone else’s carelessness (the correct legal term is “negligence”), there are two different accident claim payouts that you are entitled to receive.

    Car Damage Payout

    One is a payout for the damage to your car. This entitles you to . . .

    1. Have your car repaired.

    2. Or, if the repairs would cost more than the vehicle is worth, be given its fair market value (usually called “Actual Cash Value,” or “ACV”) before it was destroyed.

    3. A replacement (rental) vehicle while yours is being fixed or, if it was totaled, until you are paid.

    4. The cost to repair or replace any property in your vehicle that was damaged or destroyed in the accident. This includes such things as the golf clubs that were in your truck . . . right where you were hit.

    5. Of course, the cost of towing your vehicle if that was necessary.

    Sometimes, you are also entitled to . . .

    6. The amount that your car’s value was reduced by the accident. This reduction in value claim is based on the common sense notion that a buyer will not pay the same amount for a car that had extensive damage repaired that she would pay for an otherwise similar vehicle that has not had such damage. Reduction in value claims are also called diminished value (“DV”) claims or diminution of value claims.

    Look hard at the possibility of a DV claim if the damages were extensive and your vehicle is fairly new, say not more than 2 or 3 years old.

    Injury Payout

    The other payout you are entitled to receive is for any injuries that you suffered in the accident.

    This payout has two parts: financial losses and non-financial losses.

    Financial Losses

    If someone else’s carelessness causes an auto accident in which you were injured, one thing the at-fault driver (actually, his insurance company if he had insurance) must do is pay you the full amount that was spent to treat the injuries you received. Note that I said all of the medical bills, not simply your out-of-pocket co-pay or deductible amount.

    However, if your health insurance company paid any of your medical bills, it probably has a right to be repaid after you recover from the driver who caused the accident. In other words, you receive the payment from the other driver with one hand but have to use the other hand to deliver it to your health insurance company. Don’t forget, though, that the health insurance company will usually agree to reduce its claim if you ask them the right way.

    In most cases, the other financial loss that you can recover from the at-fault driver is your loss of income. This is true even if you were paid for the time you missed from work. That’s right, if you missed two weeks but were paid because you are entitled to sick leave or vacation pay from your employer, you can still collect the value of your lost time. Why? Because it’s not fair for the at-fault driver to benefit from something you negotiated with your employer and paid for. Yes, I said, paid for. Presumably, if your employer was not paying for these benefits, it would be paying you their value as additional pay.

    You can also recover any other financial losses that result from your accident. Common examples are the cost of traveling to and from doctors’ appointments and the cost of hiring people to do things you couldn’t do while you were injured, such as house cleaning and lawn mowing.

    Non-Financial Losses – Pain And Suffering

    As an injured victim of someone’s carelessness, you are also entitled to a car accident claim payout for your “non-financial losses.”

    This means that you have suffered losses that didn’t cost you money and that aren t normally measured financially.

    The main example is that, in spite of the fact you did nothing to deserve being injured, you have had to go through the experience of your injury. There may have been pain, tingling, stiffness and the like from your physical injuries. In addition, there may have been uncertainty about your recovery, about whether your job would still be available when you got well, about who was going to take care of your kids, about how you would pay your bills if you weren’t paid while you were out of work, and about many other things. True justice requires that you be compensated for these losses.

    The difficulty, of course, in calculating a car accident claim payout for these types of losses is that there is no recognized and agreed method for converting these very real losses to dollars and cents. In other words, there is no real auto accident pain and suffering settlement calculator.

    However, the fact that converting pain and suffering to dollars and cents is difficult does not mean that it should not be done. My view is that in a typical claim, this is the most significant part of the claim. Sure your vehicle was damaged and you suffered financial losses, but years after when you look back, I predict that what you will remember will be the sleepless nights, the worry and uncertainty about whether you would fully recover, when you would recover, and the like. That’s why, from my point of view, compensation for your non-financial pain and suffering damages must be more than you receive for your financial losses.
