Kansas Unemployment Questions

What is the State Extended Benefits Program?
The State Extended Benefits Program is designed to provide additional benefits to unemployed Kansans during periods of high unemployment. The program becomes effective once the state’s average seasonally adjusted unemployment rate reaches 6.5 percent or higher for three consecutive months. Under the program, individuals who exhaust their regular unemployment benefits and, in this case, any benefits through the federal Emergency Unemployment Compensation (EUC) program, may qualify for up to 13 additional weeks of benefits.

Am I eligible for state extended benefits?
To be eligible for state extended benefits, you must meet the following criteria:
o Exhausted regular state unemployment insurance benefits
o Exhausted original EUC benefits
o Exhausted Tier II EUC benefits
o If your Tier II EUC benefits exhausted after Nov. 22, 2009, you must also have exhausted Tier III EUC benefits prior to receiving state extended benefits
o Not eligible for a new state unemployment insurance claim in any state or in Canada
o Currently unemployed or working less than full time

What are extended benefits and the Emergency Unemployment Compensation 08
(EUC08) program? Extended benefits are additional unemployment insurance benefits that are available to unemployed workers when they have exhausted their regular UI benefits. Extended benefits programs are enacted during periods of high unemployment. The EUC08 extended benefits program is a federally funded emergency program providing much needed help for many Kansans and their families while they continue to look for work. Effective July 6, 2008, the President approved up to 13 weeks of EUC08 benefits to unemployed workers. On Nov. 21, 2008, the President signed an extension into law, adding up to seven additional weeks of extended benefits for Kansas workers. This brings the total maximum EUC08 benefit to 20 weeks in Kansas. The first week for which the extension benefits could be paid was the week beginning November 23, 2008.

Who can apply for EUC08 extended benefits?
The EUC08 program extends UI benefits to those who have exhausted their regular UI benefits. If eligible, applicants could receive up to 20 additional weeks of UI benefits. Eligible workers include those who:
o Have filed a valid unemployment (UI) claim and their most recent benefit year ended on or after May 1, 2007
o Have exhausted all regular UI benefits
o Have no rights to regular unemployment compensation
o Have had:(1) earnings from covered employment equal to or greater than 1.5 times the wages earned during the highest wage quarter, (2) 40 times the weekly benefit amount or (3) 20 weeks of full-time insured employment or the equivalent in insured wages in the base period of the most recent entitled claim
o Are fully or partially unemployed on or after July 6, 2008
o Are legally authorized to work in the United States
o Meet all regular unemployment eligibility criteria such as being ready, willing and able to work

Kansas unemployment benefits eligibility criteria

You are not eligible for unemployment benefits if you voluntarily quit your job without good cause, effective the day after your separation, and continuing until you become re-employed and have insured earnings of at least three times your weekly benefit amount.

You may still be eligible if you:
o Quit due to illness or injury upon the advice of a licensed and practicing health care provider.
o Quit temporary work to return to your regular full-time employer.
o Quit to enlist in the armed forces of the United States, but were rejected or delayed from entry.
o Quit due to working conditions hazardous to your physical, mental or moral well being.
o Quit due to unwelcome harassment by the employer or another employee.
o Quit to accept better work.
o Quit because the employer requested that you violate an ordinance or statute.
o Quit due to a violation of the work agreement.
o Quit due to a personal emergency.
o Quit due to the voluntary or involuntary transfer of your spouse from one job to another.
o Quit to enter training approved under the Federal Trade Act of 1974.
o Quit due to circumstances resulting from domestic violence.
For details concerning the 12 exceptions, you may obtain a copy of K.S.A. 44-706 (a) online at

After completing a temporary job assignment, you may be disqualified if you fail to request an additional assignment on the next workday if required by the employment agreement.

Texas Diminished Value

Diminished Value In Texas

Diminished Value (DV) is the loss in market value that occurs when a vehicle is wrecked and repaired. A reasonable consumer will not pay the same price for a wrecked, then repaired vehicle, as they will for a vehicle with no accident history. Even if the repairs were done well, the vehicle will still lose value.

Texas Diminished Value Claims

Texas is a diminished value state, which means you may be entitled to the diminished value of your vehicle after an auto accident. The statute of limitation on diminished value claims in Texas is 2 years, and Texas does have uninsured motorist coverage for diminished value. You can’t submit a Texas diminished value claim if you were the at-fault party in an accident, or if the damage was caused by something other than a collision. You can see if you qualify for a diminished value claim by filling in the claim review form below.

Diminished value of an automobile following an accident may occur in one of three ways:

Repair-related Texas Diminished Value – is the loss of value due to the inability to perfectly repair the vehicle. Meaning that the car is now worth less after repairs than it was before the wreck.

Immediate Texas Diminished Value – The difference in resale value of a vehicle before damage occurred, and the resale value after damage has occurred before being repaired. The immediate Diminished value also is the loss of value caused by the insurer’s direct involvement in the claim adjustment. Meaning that the insurer gains control over the repairs resulting in repairs incomplete, insufficient, and leaving the car less than standard optimal condition.

Inherent Texas Diminished Value – This is the most widely recognized and accepted form of Diminished Value. This will ensure that the best repair quality has been achieved and is defined as the amount by which the resale value of a repaired vehicle has been reduced due to accident. It is also the basis upon which any supplemental form of Diminished Value would be added.

It’s just common sense.

Let’s assume you were shopping for a late model used vehicle. You come upon a dealer who has 2 identical vehicles that match what you are looking for. These vehicles are the same year, make and model. They have the same mileage and options. They appear to be in the same general condition. The sticker price for both vehicles is $20,000. You ask the dealer if either vehicle has ever been wrecked and he tells you that one of the vehicles had sustained $6,500.00 in collision damage, but the repairs were expertly completed and you cannot tell there was ever any damage. Now there are just 2 questions that remain.
Would you still give equal consideration to each vehicle?

(If you answered no to 1) How much of a discount in the price would have to be offered in order for you to give the wrecked and repaired vehicle equal consideration?

The bottom line is:

If you were not at fault in the accident, the at-fault party (or their insurance company) owes you money. This is true in all 50 states. There is over 75 years of case law to back that up. If you live in the state of Georgia, you can collect your diminished value whether you were at fault in the accident or not. This is based on a class action lawsuit in 2001 (Mabry v State Farm).

How much value has your vehicle lost?

Don’t let the insurance company tell you. Ask The Experts at Collision Claim Associates, Inc. We are professional vehicle appraisers who will provide you with the documentation you need to get the compensation you’re entitled to.

Do I have Diminished Value? Probably, if the vehicle has no previous or significant damage. To find out for sure fill out the form below.

How do I collect on Diminished Value? You can collect by providing the insurance company with a professionally prepared Diminished Value report! The extent of your diminished value report and the methodology
Will I need help to settle my Diminished Value claim? Yes, Getting the proper help will help you to settle the claim fast. However, be aware of fast claim services as insurance companies will not respect them. You need a company that will provide detailed instructions and guide you every step of the way. Insurance companies are always looking for loop holes and ways not to have to pay out the proper money.

is the decrease in fair market value a vehicle suffers as the result of a collision, regardless of the quality of repair. Not every vehicle suffers diminished value, and not every type of damage creates diminished value. However, diminished value almost always occurs with more than slight damage, particularly when a late model or high line vehicle is involved in the accident.

When a vehicle has been damaged, merely returning the vehicle to its prior appearance and function does not return the vehicle to its pre-loss condition. Issues regarding the vehicle s warranty may arise as will it s eligibility to be sold as a Certified Pre-Owned vehicle. Alaska s Unemployment Insurance (UI) program is dedicated to providing unemployed workers fast and accurate payment of UI benefits. With the seasonal nature of much of the state s workforce and Alaska s vast remoteness, UI benefits serve not only to bridge the economic gap for the individual worker, but also as a stabilizing influence on local economies.

Have you been laid off from your job and need training for a new career? The Alaska Department of Labor and Workforce Development has grant funds available to help with training expenses. Contact your nearest Alaska job center to inquire about the Dislocated Worker Grant. For more information, call a job center near you.

Worker Resources

Workers who have become unemployed or working less than full-time hours should apply for UI benefits as soon as possible. Once you file your claim for benefits, your eligibility determination can be made resulting in a timely payment of benefits.

Work search
All workers are required to register for work and to actively seek and report weekly work searches to be eligible for benefits. Failure to register for work or to report required work searches can potentially result in the denial of benefits. A convenient Work Search Log (PDF) is available for recording keeping.

The procedures and policies of Alaska s UI program are based on Alaska statutes and regulations. Alaska administers different types of UI programs and when available, State Extended Benefits and Federal Extensions.

claim my weeks Claim Your Weeks – Florida Unemployment Weekly Claim

FLUID is the state of Florida s online unemployment program, which allows workers who have lost a job to apply for and receive compensation for a set number of weeks. If you have lost your job through no fault of your own, you can apply for and will likely receive benefits through the FLUID program. The amount of money you will receive each unemployment claim week will vary, depending on how much money you have earned at your current position. As of 2011, you will receive between $32 and $275 per unemployment claim week. The only way to receive unemployment benefits through the FLUID system is to file an initial claim, and then file for each of the claim weeks you are unemployed. You can apply for unemployment in Florida online, using the online FLUID system .

File an initial claim

To begin receiving unemployment compensation from the state of Florida, you will need to file an initial claim. Visit the FLUID online system and fill out the requested information. You will need to provide your personal information, including your name, address and social security number. You will also need to supply the name and address of your employer and information about the amount of time you worked and the income you have earned. You can find most of your employer information on your paystub. Allow about an hour to file your initial FLUID claim.

After your initial claim is filed, you will receive an email confirmation from the state, letting you know your claim is being processed. As of 2011, Florida also requires applicants to complete an online skills review, which covers basic reading and math skills and will take about an hour to finish. Upon completion of the skills review, your claim will be processed and your benefits will begin. It may take up to four weeks to receive your first unemployment payment, but you must file FLUIDnow claim weeks on time to be sure you receive a payment each week.

Claim each week

Every week you are unemployed, you will need to file a FLUID benefit claim. You can file for your FLUIDnow claim weeks any day of the week; you will need to make a new claim every two weeks to ensure that you continue receiving unemployment benefits.

To make your weekly Fluid claim, you will need to log into the FLUID system and complete a short form that confirms that you were looking for work and that you were available for work. As long as you are actively seeking work and are available to work when a position becomes available, you will continue to receive unemployment benefits for the duration of your approved period. The only way to receive unemployment benefits is to file a weekly FLUID claim; it is essential to file your claim each time you are supposed to. Delays in completing the weekly FLUID claim will cause payment delays as well.

Your eligibility to receive unemployment compensation will be determined after your initial claim is filed. You will also need to confirm your availability and willingness to work as part of your weekly claims to continue to be eligible for benefits.

In most cases, you will be approved for unemployment in Florida, provided that you worked for enough weeks in the period before you lost your job, you earned enough income in that job, and you lost your job through no fault of your own. Getting fired for a reason, or simply quitting your job may mean you are not eligible for unemployment. If you are in doubt, file a claim with the online FLUID system to be sure.

If you have submitted an application to the FLUID program, but have been declined, you may file an appeal. You will likely need to provide an appeal, offering more detailed information about your job and the reason you left, and may need to attend an in person interview to determine your eligibility.
